For me, I feel any political party that values its participation in the 2023 elections should not even allow any political appointee near its activity by 1000 miles until the Supreme Court rules.
Yes, because the SC has not ruled on this case therefore it could go just anywhere.

. The primary is a party exercise according to the laid down rules.Section 84 says all political appointees should resign if they intend to contest in any election. APC has the right to disqualify any aspirant who refuses to comply with the constitunal requirements. I expect the SC to sustain this provision in their ruling for it will bring sanity into our elections. However since there has been a case on this at the supreme court it is a waste of time entertaining it again at the Federal High Court.l

The Appeal Court in Oni v Fayemi in 2018 insisted that Party Guidelines cannot affect Public Servants who are not employed in the Service of the Federation.

The case started with Fayemi who resigned as a Minister, 4 days after he had won the Ekiti APC Primaries. The Appeal Court therefore, stated that Ministers and Political Appointees are not EMPLOYED like Civil Servants hence are not caught up with the Party Guidelines rule. The Supreme Court did not decide on it so we wait, it is risky though 'cos it could go anywhere.

In the build up to the 2022 primaries, the APC specifically announced that even public servants who want to apply for office must resign 30 days before the primaries or they will be screened out.

This is just like the party saying if you want to contest, find 5 delegate per state. It is not in the constitution but it is a party guideline and the party has the right to set those guidelines as they see fit

Some of you the kind emotion you put into democratic choice is unbecoming. Just wish to impress on everyone your own democratic choice. That's not how democracy works.
It is everyone golden choice to support and mobilize for whoever or party they wish and not under any obligation to follow your choice.
Why not just canvass for your candidates and party and leave others to theirs.

I now see what you are saying. This is it.

No political appointee at any level shall be a voting delegate or be voted for the purpose of the nomination of candidates.Any political office holder interested in contesting for an elective office shall leave office 30 days prior to the date of election or party primary for the office sought.

I still believe this lawyer will win it.

This is an abridgement of S84(12). The Appeal Court nullified it yesterday. We don't know if the PDP will appeal.

I don't see how it stands:/
Section 137(1):g of the 1999 CFRN.
A person shall not be qualified for election to the office of President if being a person employed in the civil or public service of the Federation or of any State, he has not resigned, withdrawn or retired from the employment at least thirty days before the date of the election.

If you check carefully, the APC expanded the frontiers of their own Act!

“The same fate will befall any provision of the Act which seeks to enlarge, curtail or alter existing provision of the constitution. The provision or provisions will be treated as unconstitutional and therefore null and void.” (SC in AG Abia v AGF)

“It is my view that a political party is able to control the affairs of the party only to the extent that the exercise of such control does not run against the provisions of the constitution…”. (SC in Amaechi v INEC)

Yes, they do....provided it doesn't run Contrary to the Constitution.
The delegate-ship issue is within the purview of the Party, so they won't run foul of it.
