Milljack:The court won't be foolish to order for fresh election bcoz the judgement wasn't based on playing against d rules of the party or malpractices during d primary election nor subjugation. I think PDP will receive Lyon treatment. It's just a pre-election matter as that of Lyon. |

WarriAproko:I just explained what d part u circled in d electral act as amended says na. Since the court has disqualified dia candidate based on false credentials, they've lose it. There would've been replacement with second runner-up in the primary election if d judgement had based on electoral irregularities or general malpractices. |

mastermaestro:I think it depends on the culture, I am multi-named and if I check some of my documents the only constant names are my surname and my first name...which is an English name. My mom named me twice, my father named me once and my grandma named me once, and religion added a last one. Those are the middle names that I could use, but in the extnded family everyone who was old enough when I was born is allowed to name me and call me the name he chose. now in my earliest document my middle name has been either of the two selected by my mother... when I was very young she used the name I was called at home and changed it again when I changed school. Fortunately for me, I regulated all that with my primary 6, wassce, bsc, nysc and master all with the same middle name. then i did a local government registration of birth, national population commission birth certificate all reading the same middle name. that way all the documents that matter have the same middle name. I have stopped presented any document that doesn't have the exact 3 official names I currently use. I am from the south-South and my brother probable has a similar problem, he incorporated a new middle name during his wassce... If the guy is from a similar culture, it is probably understandable. |

garfield1:Ekwo did not do that. The submission and substitution window had closed. The luck these ones have is that while in the past INEC will close submission like 2 months before election, now they gave enough time to the General Election. Read the SC judgement of Saleh v Abah. Again, Substitution is open till 180 days to the general election. |

garfield1:29(5) & 29(6) is a continuation from 29(1). They are to be read in conjunction and not isolation. In the old Electoral Act, window closes 60 days to the general election. S31(1) of the EA2010. In this new one, it is 180 days....... |

garfield1:I read thoroughly before I posted the screenshot. That section is referencing when that submission window has been closed. as in natural numeric counting, you start with 1, 2 and so on. I understand the morality angle, but the Court does not answer hypothetical questions. |

fergie001:No,the section is not referencing anything substitution.it never made mention of any timeline.it clearly specifies that once an aspirant goes to court and succeeds whether before or after,the party is out.do not introduce extraneous issues...there is no morality or hypothesis involved here.once a party defaults,he or she is out. |

Look at the intendment of the lawmakers about substitution.it is meant for natural circumstances like death,serious ailment and withdrawal which has nothing to do with breaking the law....the lawmakers never intended disq to be a ground for substitution. During pre election and election,candidates are tied to parties.whatever affects one affects the other. |

Peacecore:Why are you reading (5) and (6) without reading (1)? When counting numbers, you start from 1, 2, 3 and not 5. That's how the Constitution and Electoral Act are read. In Conjunction.... Section 29(1) is a carry over from 31(1) from the old Electoral Act. The SC married both the old 31(1), 31(5) & 31(6) in PDP v Degi. Has PDP submitted their Dep-Gov Guber Candidate? Anybody can still drop now, everyone including the Candidates themselves can still be substituted. Section 29(1) must take place before 2, 3 and others will follow. Read PDP v Degi, APC v Obaseki, Saleh v Abah. If for example, it is less than 180 days to the election, then PDP will not participate. The Primary wasn't nullified as you rightly said but the winner's vote is voided, destroyed, empty. There is no final list for now....INEC reiterated that last week. The Judge was right in his Judgement. Will you say APC who violated their Act like in Akpabio, Lawan, Machina or PDP like in Edo also don't have Candidiates because INEC didn't list them? |
