If Kyari is still a serving officer he wouldn't have been charged in court in the first place.
In FG vs Buruji Kasha my, the court upheld the extradition of a serving senator of the federal republic. Check the excerpt below

The drug allegation was the FG's orchestrated tactic to prevent Kyari from being extradited. It was simply a kangaroo arrangement. Why not sign his extradition order when America first made the move? Why jettison the initial report of the panel headed by a southerner over kyaris case and Why did they have to constitute another panel now headed by a Northern police officer? All these were delay tactics. Suddenly, they said someone facing extradition had indulged in drug crime and charged the case in court. The fed govt now filed for his extradition when there was already an established case against him? Only fools will believe all these nonsense. America would just be shaking their heads now, over this matter. Kyari can run, he can't hide. The govt that would sign his extradition order is coming.

America does not allow for any of her citizens to be extradited to face trial under any circumstances. Why should the rest of the world not do same.
