The stay of execution was not denied but withdrawn at the behest of Pinheiro SAN for Adebutu. It is normal practice in Court that when cases have been transmitted to higher Courts, their lawyers withdraw it so that the Judge won't rule thereby passing a judgement on it.

Just like the Umahi's case recently where the FHC struck out the stay of execution because the lawyer had transmitted to a Higher Court.
