I think they have to take him back to Kenya then go through court process before Kenya can extradite him that's if government wins in Kenya before any court in Nigeria will have the right to entertain his case again based on the appeal court ruling.

No supreme court will agree, that does not mean that his status as a fugitive and enemy of the state has been abolished. His crimes for pushing many illiterate of Igbo extraction into crimes by picking up arms against the state is heinous and must be punished to let any potential block head knows that they are reward for foolishness.

That's the essence of the higher court , the case should be struck out in favour of Nnamdi Kanu if the appeal judgement is upheld but you can't say they shouldn 't ‘’try their luck‘’ at the supreme court first, only an unreasonable people will not try their chance legally if the opportunity presents itself.

ASUU judgement comes to mind.

ASUU did not also obey the order of the lower court before they filed an appeal , it was at the highest court on industrial matter they lost.

The industrial court ruled against ASUU and ordered them to resume, ASUU went ahead to appeal and the case was thrown out as the appeal court insisted they obey the first court order before any other thing.

Now an appeal court has ordered for Nnamdi Kanu to be released, the same FG has refused to obey the order before appealing it.

And it is going to be no surprise if the same judiciary goes ahead to entertain the appeal against Kanu even when the government is yet to obey the first order. The kind of reckless precedence Buhari and his administration are setting in this country, one has to pray that these things don't return to haunt us in the near future.

But the court heard the appeal of ASUU first before it was struck out, so why can't the FG approach first even if it will be eventually struck out？
