The law enforcement agencies are not independent. They are under the executive arm of government. Meaning that the president still calls the shots.

So the courts are powerless against the executive arm. Except in a situation where the force just wants to work against the president.

The judiciary in the US is the most powerful of the three organs of government, for example Biden announced a $10,000 student loan forgiveness, but ordinary High court blocked him from going ahead, they are now waiting for final decision from Supreme Court.

So in the case of the COAS, who wan arrest am, based on say, only 1 person dey everly chop COAS, as all him course mates must be compulsory retired for him to attain COAS.

In Nigeria this is a court order that will not be obeyed. Firstly, a commanding officer can be said to be acting under the instructions of a President who has immunity from prosecution during his tenure. This is why a soldier will need to be dismissed from the army before he can be tried by civil law. Else he can only be tried under military law.

This judge is grandstanding. Foolishly too.
