The person that ce 2nd in the PDP governorship primaries automatically become the party's flag bearer and not the deceased deputy.
Remember the case of Yahaya Bello and Falake after the death of Prince Audu Abubakar during the secondary election.

Abubakar Audu and Faleke was different from this one. At this stage, the Party can nominate replacement. In Faleke's case,
Election was 91% completed when Audu died. The running mate was supposed to takeover having participated in the election up till the time of Audu's death.

In this case, the decision lies with the Party. What happened in Audu's case cannot happen if it were Presidential election or even in gubernatorial election of Lagos or any South West State.

Provided that in the case of such withdrawal or death of a candidate, the political party affected shall, within 14 days of the occurrence of the event, hold a fresh primary election to produce and submit a fresh candidate to the Commission for the election concerned.

You are not correct. Yahaya Bello's case happened before the this new Electoral Act.

Section 34 takes place when nomination paper or voting has started, not in this case.

You're not getting my point. Elections will hold on march 11. If after the election and a winner is declared and after collecting certificate of return, the candidate dies before swearing-in in May, does his death invalidate the deputy gov's certificate as well? If yes, how is the void filled? Does the party who came second become winner, or the winning party is allowed to present a replacement. That's my question.

Don't forget that in Yahaya Bello's case, INEC was alleged to have deliberately refused to continue to declare results after being informed of Audu's death in deference to the powers that be, to forestall the possibility of a certain tribe and religion becoming gov.

Abiriba..a village in Abia state..
Everybody answers the same names.
Kalu is also very predominant.

I know 3 cousins who all bear same first names.

(2) The list of voters to be used at a postponed election shall be the official voters register which was to be used if the election had not been postponed.

(3) If after the commencement of polls and before the announcement of the final result and declaration of a winner, a candidate dies —
(a) the Commission shall, being satisfied of the fact of the death, suspend the election for a period not more than 21 days; and
(b) in the case of election into a legislative House, the election shall start afresh and the political party whose candidate died may, if it intends to continue to participate in the election, conduct a fresh primary within 14 days of the death of its candidate and submit the name of a new candidate to the Commission to replace the dead candidate:

Provided that in the case of presidential or gubernatorial or Federal Capital Territory Area Council election, the running mate shall continue with the election and nominate a new running mate.

I just quoted you but the response wasn't actually for you.
The law today is this: If election is holding and before the final announcement of the winner, the Candidate drops dead.. the deputy will continue (i.e. for President/Governor).

If it's for legislature, that election will be cancelled and start afresh within 21 days.

Don't forget that in Yahaya Bello's case, INEC was alleged to have deliberately refused to continue to declare results after being informed of Audu's death in deference to the powers that be, to forestall the possibility of a certain tribe and religion becoming gov.
This new Act was borne out of the Bello situation. Before the Bello situation, there was no legal backing to it so INEC was even confused on what to do.

The case of Audu was that he hadn't been declared winner because the election was inconclusive. If the election wasn't inconclusive, INEC will continue to reel out results and maybe Faleke will have been Gov.

If same scenario happened today, Faleke will be Governor.

Section 33 & Section 34 of the new electoral Law 2022 to most people are as a result of magomago and bad belle of the politics of Abubakar Audu's death. We have gotten two different circumstances of clear misdirection of justice, first was the case of Amaechi and Celestine Omeliha and the second was that of Faleke.

This time around, everything lies with the party. Campaign will stop in February. The party cannot rely on 14 days constitutional provision to produce another candidate except they are bringing an already popular candidate such as Abaribe on board. Election is becoming very spiritual in Nigeria. Ikpeazu does not want Abaribe but there is no time to market a new candidate.
