What of if Atiku collide with Presiding officers in Tinubu Strong hold in the north using tribalism? Etc

Maybe the judge has allegedly taken money, so was in a last to deliver judgement, then fail to read.

The tribunal has no time for assumptions.

Read 57 too. I do not have the figures to know the difference between the number of people that collected their PVC in the affected PUs and the new margin of victory for Oyetola.

But I do believe that that must have been considered too

That only applies before the election result is declared and winner declared. That clause does not apply at the level of election petition at the tribunal. If this was not taken into account at the level of declaration of result, the tribunal cannot direct INEC to conduct another election. Rather the tribunal makes judgment one way or the other.

The Presiding Officer did not cancel the affected election.

What the Court did was to exclude the over voting from the valid votes.

No Political party should be allowed to wilfully, knowing and carelessly drag others to any rerun

That section applies before a Return is pronounced. After pronouncing the winner, whoever goes to court must win if he proves that the regulation has been breached.
