The same tribunal also said INEC committed crime by issuing the second report. You want them to take that second report into consideration? Something they condemned. You are emotional here.
Report is not recognized by law but BVAS is.

Normally, a legally sound judgment would not be upturned. Of course, anything is possible, but I don't know why any lawyer would look at a sound judgement and not believe the Supreme Court would uphold it. Mr Amadi is in order.
This is Nigeria though, if Atilu wins Adeleke can start dancing in full to Osun government house without any fear, but if Tinubu wins, he must run comot

RHYTHM OF DESPERATION FROM THE OPPOSITION:
NO CAUSE FOR ALARM, Sen. ADEMOLA ADELEKE REMAINS GOVERNOR OF OSUN STATE.

The Osun Tribunal today 27th January, 2023 gave 2 rulings.
The undeniable truth establishing the fact that His Excellency, Sen Ademola Adeleke is eligible and qualified to contest for the July 16 governorship election was the first, and the second that Oyetola won the election while claiming the documents APC tendered to prove over-voting were incomplete due to non-inclusion of registers of voters used at the challenged units.

Isn’t this some sort of malicious ruling?

Well, let’s consider this judgment as a tool to distract good governance in the state, which the Executive Governor will not fall for.

Leveraging on the Boast of confidence to be back in power by July 2023, as said by the outgoing speaker of the Osun House of Assembly, it is evident that the opposition are desperate to continue amassing the common wealth of the citizens of Osun.

To the interest of the general public, kindly consider the judgement of the tribunal as a means to wet the appetite of opposition, and to boost their moral to vote Tinubu as the next president such that when he wins, they can boycott and by over the Appeal and Supreme Court ruling against Sen Ademola Adeleke which must never happen.
The paradigm shift of a true Democracy has begun in Osun State and Nigeria at large, and no court of law presided over by any bias judge or judicial panel will clamp down the gong of a new democracy.

This publication will also serve as note of reminder to all citizens of Osun that everyone should be determined to vote the candidate of their choice and as such a candidate that can transform the economy of the nation at the presidential polls, for the good of the state and the nation at large.

Meanwhile, Sen Ademola Adeleke remains the Executive Governor of Osun State and the people’s mandate this time will not be taken.

We await a positive Appeal court ruling.

I've read bigger grammar than this and they don't serve better purpose than academical exercise. The only thing that can give this grammar tangible meaning is Atku"s victory

But does the number of cancelled votes demands a rerun to ascertain a winner?
The 2022 electoral act is very clear on this.

Sorry I initially assumed you are one of those people on Nairaland who can’t reason past their emotions.
The truth is I am pro APC but I won’t lose a minute sleep if they loose all the elections.
I never personally benefited from their being in power.
The APC government embezzled the money meant for the construction of the road leading to my house in Nigeria and signed that the road has been constructed. So screw them.
Back to the election matter:
How will INEC prove that they didn’t put the data in the BIVAS post the pendency of the suit filed by Oyetola?
Wether INEC is at fault or all the parties contributed to the over voting, one thing is constant: Section 51 of the Electoral Act 2022.
Once their is over voting the whole exercise shall be cancelled.
That’s exactly what the tribunal just established.
Both the PDP and INEC lawyers agreed that there was over voting in those polling units.

INEC had the custody of the BIVAS machine and they can not proof that they didn’t update it after the fact.

They shot themselves in the feet by the original BIVAS result they issued to the APC and Oyetola. It was a legally binding document and they can’t invalidate their own document.

The thing that should worry every reasonable Nigerian is if this same over voting should be allowed to happen in 13 states during the presidential election, it means we there shall be a rerun of the presidential election.

The INEC officers and the adhoc staff in charge of Osun election should be prosecuted and jailed.
This will ensure that our elections are credible.

Remember, BIVAS introduced in EA 2022 is to prevent the server issue Atiku and the PDP were planning to exploit in 2019.

It doesn’t matter how many votes recorded in the EC8, the vote cast must not exceed the number of voters accredited by BIVAS.

The BIVAS is the game changer.

rolams:
Sorry, you need to be neutral before you can understand what I am saying. If INEC commits a blunder, it will be unfair to make a candidate suffer the effect.

To correct this, all the necessary materials must be examine. The machine used were brought to the court for examination but was it examine?

Does the electoral act say that in the event of over voting , the votes in that locality should be cancelled and the votes deducted? Where does the court derive that power? What if the votes were for a party like AA?
Read section 136 of the 2022 electoral act pls

Yes.all the three reports analysis proved overvoting.even respondents conceded that there was overvoting
Overvoting is impossible as an unaccredited voter cannot vote. What is in contention is the time of recorded vote and what the PU officer recorded

Lol, because it happened in someone strong base makes him the culprit? Lol you are a clown just like the black market judgement.
Emotions even made you to be blind to see that I didn't say that Ade was the culprit. I only said that it affected him most bcoz majority of overvoting happened in his strongholds. Anyway, as a simp you are, you have nothing to do with politics section, rather you should be in Romance section.

My bro. It seems you didn't follow the case. PDP never agreed to the statement of over voting. Again, the machine was brought to the court for examination, an expert was called to examine it. Look at America election, the voting machines were examine and the judgement was based on it.

Again, INEC has been saying that the result given to the APC is yet to be fully synchronized but under the law, they are bound to issue it.

My fear is this, if care is not taken, this judgement will create an avenue to discredit our electoral system and the will of the people will always be upturned at the court. All the loser needs to do is wait till after the election, request for the unsynchronized result from the opponent stronghold and the court will base their judgement on it to pronounce the loser as the winner. The units will be cancelled and the electoral exercise will become useless.

BVAS that was used at the polling units for accreditation and the form EC8 used to write the results are the most reliable source to get the required information.

Inec as a matter of urgency should deal with the officials that tampered with the bva if they are culpable. They are the idiots giving the politicians hope of rigging the election.
Will INEC take the steps? AO 1 A,0 11 and others recruited staff including corpoer are easily influenced by politicians to rig elections.

Is there any justification for the issuance of 3or 2 different BVAS reports? INEC did not do well at all

There is nothing to expose or cover here, I am clearly against Oyetola and his party maybe you haven't noticed me on this forum.
I was only trying to say a rerun was the right thing to do, which to me is still in favour of Adeleke. Let Oyetola go and prove his popularity again.
I expect you to say something about the facts of the judgement as I stated, don't just be telling us who goofed and who didn't. Tell us how they goofed and didn't goof. It is called intellectual discuss.
the electoral act mandates the tribunal to cancel fictitious votes and declare the person with the highest vote the winner. That's what the tribunal did.

. There is no need of examining the machines through a technicians. The reports of the. BVAS are enough. INEC assured the voters in Osun that everything was set for the election.Checking the machines at the TB is illogical.

did you read what you posted? Did you see court or tribunal there? What is there is presiding officer at the polling unit and that refers to events on the day of election. Did you readbthe part that says no return and declaration should be made? Was adeleke not returned and subsequently sworn in? That section has nothing to do with tribunal. You guys should learn to read and understand. Don't read with emotion.
