then why all the billions spend on bvas, when inec already know, they are to opt for manual transmission of results ? why all these sufferings in our nation, in the name of cashless policy and naira re-design to avoid vote buying, during the election, yet the election was never transparent nor fair ? the credibility of inec as an organisation, is clearly at stake. |

Jokay07: are u sure u can sleep with 2 eyes close? The constitution states INEC will announce the procedure to be deployed for the election inline with BVAS. Did INEC announce a procedure to the Nigerian people as stipulated by the constitution ore election? So what procedure did INEC announce b4 the elections? better sleep and wake up and see ur stolen mandate has gone to the rightful owner. |

Direct e-transmission of election results is mandatory Section 60(5) of the Electoral Act 2022 provides that “The presiding officer shall transfer the results including total number of an accredited voters and the results of the ballot in a manner prescribed by the Commission”. The use of “shall” here, it’s respectfully submitted, implies that the presiding officer must transmit the results as prescribed by the INEC Guidelines. The Independent National Electoral Commission (INEC) on 3 June 2022 released the Regulations and Guidelines for the Conduct of Elections, 2022. The Regulations and Guidelines were issued pursuant to Section 149 of the Electoral Act, 2022 and the Regulations and Guidelines supersede all previous regulations and/or guidelines on the conduct of elections, issued by the INEC. |

The new Regulations and Guidelines cover elections and arrangements for their conduct, accreditation and voting procedure at elections, and collation of election results and making returns. They apply to the conduct of elections to offices of: “President and Vice President; Governor and Deputy Governor; National Assembly (Senate and House of Representatives); State Houses of Assembly; Chairmen and Vice-Chairmen of the Federal Capital Territory (FCT) Area Councils; and Councillors of FCT Area Councils Legislature. Paragraph 38 of the Regulations and Guidelines, 2023 makes Electronic Transmission of Results and Upload of Results to IReV mandatory. The paragraph requires that when voting and announcement of results have been completed at a polling unit, the Presiding Officer “(1) must Electronically transmit the result of the polling unit to INEC’s collation system; (2) Must use the BVAs to upload a scanned copy of the EC8A result sheet to the INEC Result Viewing Portal (IReV); and (3) [must thereafter] Take the BVAS and the original copies of all forms in a tamper evident envelope to the RA/Ward Collation officer in the company of security agents. Polling Agents may accompany the PO to the RA/Ward Collation Centre”. [See:Simplified Electoral Act 2022, and INEC Guidelines. Thus, the Regulations and Guidelines require that the presiding officer must electronically transmit the results DIRECT from the polling units, after which the results would then be taken manually to the collation centres. |

IGBOSON1:The information is correct as the transmission of result either through manual or electronic means rest squarely on the decision of INEC which the commission had made in the guidelines and regulations of INEC and was released last year! In summary,INEC through their own guidelines and regulations, mandated the transmission of results through electronic means from the polling units which is in tandem with the amended electoral laws! |

Jokay07: Instead of you to answer my simple question inside the other uncrowded harmless thread,, you're here mentioning my moniker on another thread. Nevertheless,, I will still respond to you.. Now.. Let me still drag you back to that same Electoral-Act-2022: Section-64; Sub-Section-(4);.(a-&-b).. The words there are very clear. We can all agree that the “Directly-Transmitted Results From The Various Polling-units”, as described inside the Electoral Act, could be done using any method on this earth, (be it “Optical-Fibre Transmission”, “Solar-Waves Transmission”, “Radio Transmission”, “Sonar Transmission”, and even “Seismic Transmission” too),, but definitely NOT “Manual Transmission”, because it wouldn't satisfy the expected requirements of the Electoral Act. Section-64(4) of the Electoral Act simply maintains that, no matter the Method or Mode which INEC employed for the Transmission of the results (“Directly from the Polling-units”),, it MUST be completely done-and-dusted with before the Collations that are supposed to use the results from those polling-units would start. This is because,, those directly transmitted results are the results which the Collation Officers at the various “WARDS COLLATION CENTERS” must use to satisfy the requirements of the Section-64(4) of the Electoral-Act-2022. Therefore,, this particular Court-Ruling still didn't deflate my arguments.. Please read the Section-64; Sub-Section-(4):.(a-&-b) of the Electoral-Act-2022 again,, and explain it well to me,, just in case I am not understanding it very well.. |

You see INEC boldly defending her incompetence with the electoral act. Then you begin to think if these laws were designed to take us back to stone age. The Nigerian flag has lost most of its color, in so much that what some of us now see is a high flying rag, shredded by ethnic bias and bigotry. The only institutions that seem to have the trust of meaningful Nigerians to some good degree now are the banking institutions and Telcos. This is where the average Nigerian draws solace from. Your bank transactions and internet connection at this moment, despite their hiccups, can be far trusted than all the arms of the government put together. This could be the last hanging thread, keeping Nigeria from off a civil conflict. Who knows.. Look up the definition of a failed state and ask yourself how many steps away from that are we. |

If inec gave a contrary training to their presiding officers,then the commission has defaulted in their own laws of which there are grave consequences for such actions which may include an outright cancellations of the presidential election assuming you are right in your assertions! This is why inec came up with a guideline and regulations for the 2023 elections last year where they specified their mode of transmission which is through electronic means directly from the polling unit! Any last minute alteration from their guideline and regulations will be seen as an act of disobedience against their own laws and there are grave consequences! |

bentenny: Yes,INEC has its own guidelines and regulations but they have the power to act against them when the situation calls for it. But not carrying the parties along on the need to take such step is where the mistake came in. |
