Reports that Peter Obi in his election petition is not seeking to be declared the winner of the election is false and misleading. I’ve seen a copy of the petition. Peter Obi has prayed that he should be declared the winner. The law allows a petitioner to seek alternative reliefs.

That is what Peter Obi and Labour Party have done in their petition before the Court of Appeal. They are seeking reliefs in the alternative; either that he be declared as the winner having scored majority of lawful votes cast, or that the entire election be nullified.

There is no issue here. Those who are making issues out of the imbalanced media reports on the contents of the petition are doing so either because they’ve not seen and read the petition, or they are mischievous or they don’t understand.

Let’s see how this turns out eventually.

On what ground would you say INEC should disqualify a candidate and not eligible to contest.

That INEC should disregard the vote of the 1st and 2nd respondent, and hence declare the 1st petitioner as the winner. Then what should Atiku that came 2nd with over 6.8m votes do?

I think some SANs need to think deeply before filing a petition because these are pre-election matters than is the responsibility of the party not the opposition.

Well, it would be interesting to see the outcome of the Tribunal but honestly I expected something solid from the Obi's legal team and not this joke.

No, it's tactical, it doesn't have to make sense. Judgement can be given on technicalities (we have seen this countless times). Since it has to get to the supreme court, have as many grounds as possible. This is Nigeria.

PS: The point about who came second is a nullity because LP is contesting the whole votes allocation called collation. I believe they have evidence to prove they scored higher lawful votes.

This petition should not have to rely on technicalities. That is too fragile to lay this on. Facts as clear as water only.

What's the difference? Premium Times gave a summary of the prayers/ reliefs he sought.

The best possible result for Obi from the day he got the Labour Party ticket was always a rerun of the elections. He didn't get 25% in 24 States. The tribunal cannot declare him winner of the election.

Contrary to the rumours spread on social media, nowhere in the entire electoral act mentions electronic transmission of results.

Obi knows he lost. His lawyers know he lost. Coming out to admit his loss will make his supporters pessimistic that he may ever win. His best hope is to push the narrative the INEC and the judiciary denied his mandate.

This is the weakest presidential election petition in Nigeria's history. The PDP who came second have realized they have no case. 4 of the prayers will be struck out by the court and the court will only focus on the 25% in the FCT contention to clarify their earlier decisions. The Judges should get prepared for insults from obidîots.

Prayer 1 & 2 that Tinubu is not qualified and didn't score 25% in the FCT are their main arguments. The rest are alternatives. It is based on the premise that if Tinubu was not qualified to contest ab initio that his votes did not count and therefore Obi had the highest votes cast and scored 25% in at least 24 States.

Atiku obviously did not win 25% in 2/3 of the states and Abuja.

Obi's team will avail themselves of this court procedure to prove that he won the majority of the lawful votes cast, and that he achieved the constitutionally-approved spread of get 25% from at least 2/3 of the states and Abuja.

Obi is about to take Tinubu to school.
You can't really be sure what the outcome will be. Even if you're, circumspection is required in a matter like this. Let's carefully watch as things unfold.

One of the prayers is that Tinubu did win not the majority of the valid votes cast. The legal implication of this is that after the votes validly scored by Tinubu have allocated to him and votes illegally added to his votes have been deducted and added to those of Peter Obi the votes will be enough to make Obi the winner of the presidential election. For example, if Obi is able to prove by credible evidence that he polled 500000 votes, but that only 5000 votes were credited him and the rest illegally added to those scored by Tinubu. If 450000 votes is subtracted from Tinubu's votes and added those of Obi, Tinubu's votes will be reduced by that number. The same is applicable to other states . That is what is meant by that prayer.
There are four or five grounds under the Electoral Act on the basis of which a petitioner can challenge an election in Nigeria. It's a technical issue.

You should know that Obi understands the implications of challenging the results on basis of its being rigged. If Obi had contended that the election was rigged, he couldn't have at the same time asked that he be declared a winner on the basis of an exercise that violated the due process as was held Onoh Vs Nwobodo.

However, Obi can do that in the alternative which he has done in this case. Therefore, the petition is in order.

Please indulge me, why is he asking for INEC to conduct another election?

Exactly. The APC senatorial ticket was given to another candidate after Tinubu picked Shettima. At no time did Shettima contest as vice president and senator.

The candidate contested and won senatorial elections. This is the weakest presidential election petition I've seen.

You know why it is difficult to engage you, people. Go to school; you say no. I say disqualify that man and declare me a winner; that is my request at this stage. You have to respond that you were duly elected. Then I will have to tell the court with my evidence why I said you should be disqualified. I don't need to empty my words in a petition at this stsge

It's a pity.

The way some of you talk out of hate reminds me of Yeshua and the mob shouting, 'crucify him, crucify him'.

This man is only out to make sure the slaughter didn't continue, that the stealing didn't continue, that sanity returns.

Building a case that has time limit is done with caution, hence what you are seeing.

You should go and read the constitution and the electoral act very well and if you follow the elections in Nigeria very well you will have an understanding.

I asked on what ground would 1st respondent be disqualified if he was passed on by party as well as INEC. This has to be stated just like Oyetola is using to support his legal battle in Osun on the basis of forgery allegations on Adeleke.

And if Obi is claiming this then, what should an Atiku that got 25% in 21 states do?

You guys don't understand how elections work as you are headless mob and the reason that if this election is conducted a 100 times you will always loose.

Btw, the result showed that Obi won 25% in 16 states and it would be nice you show us the result of how he won 25% in 24 states.

Why not allow them prove their case in the court? Obi isn't a baby in court matters. He's the first to ever get his mandate from the court twice

Just chill and let them prove their case. It's all about prove and I believe, if Obi don't have enough prove after accessing the IREV and BIVAS, he won't be going to tribunal
