Votes Cast In All Parts Of Nigeria Are Equal, Abuja Taken As 37th State, Says Femi Falana, SAN.

He noted that court decisions on the status of Abuja already exist. Femi Falana, SAN says votes cast in all parts of Nigeria are equal, adding that Abuja – the Federal Capital Territory – has been interpreted to be the 37th state of the country.

He was commenting on Section 134 of the 1999 Constitution which has become a contending issue in the aftermath of the 2023 presidential election.

But on Channels Television Sunday Politics, Falana said he will not be making a definite comment on the issue at the moment since it has become a serious legal matter now pending in court, noting that court decisions on the status of Abuja already exist.

I had expressed an opinion on section 134 of the Constitution on the 23rd of January this year – that is about a month before the presidential election. On that occasion, I expressed a legal opinion and that is why I was very hesitant to join the bandwagon when lawyers started to give political interpretations of that section.

“I did state that there is no electoral college in Nigeria and therefore the votes cast or recorded in any part of the country are equal. Section 134 of the Constitution specifically requires a winner of a presidential election to meet certain requirements. The first one is to score the majority of lawful votes and the second is territorial spread, a two-thirds majority of the states and the Federal Capital Territory.

“And since the FCT has been interpreted to be a 37th state in Nigeria for the purpose of the constitution I didn’t see any controversy at the material time and that was when I expressed my opinion.


“But now that it has become a serious legal issue and the matter is now pending in court, I am very reluctant to speak definitively on the section because there are decisions of the court on the status of Abuja,” Falana said.

Section 134 sub-section 1 (b) of the 1999 Constitution states that a winner of a presidential election must not have less than one-quarter of the votes cast at the election in each of at least two-thirds of all the states in the federation and the Federal Capital Territory, Abuja.

Bola Tinubu of the All Progressives Congress (APC), who was declared winner of the February 25 presidential election by the Independent National Electoral Commission (INEC) failed to secure 25% votes in the FCT, raising concerns about the interpretation that section of the Constitution.

Both Atiku Abubakar of the Peoples Democratic Party and Peter Obi of the Labour Party have filed petitions at the Presidential Election Tribunal challenging Tinubu’s declaration as the winner of the 2023 presidential election. Atiku and Obi were placed second and third respectively.

For law to recognize any election in Nigeria, it needs to hold in a state. This is why FCT is made 37th state during election. So that any votes you secure from there won’t be a waste. That’s why. Nothing else..

If FCT is treated as a state during elections then Nigeria has short changed the people of FCT, I have explained this already on a thread I created, Abuja does not have the structure of other states politically, remove special privilege and it will hurt them, that was the same thing that made them suffer for ministerial appointments till they fought it to supreme court, remember they don't have governorship election, so the presidential election doubles as their governorship election, you see why it has to be mandatory you get t least 25% there, they also don't have house of assembly election, so you can't treat them as other states.

They need that special privilege if you do not want to short change them, I will be posting a new topic on this issue hopefully this night..

Why? Falana is entitled to his own personal opinion. Like I said in the thread I created, no leading presidential candidate has ever fallen short of the 25%. Tinubu has broken the record.

Even Falana has refused to comment further on it. Let's hear what the supreme court says.

FCT is never treated as a State. It stands alone for candidate to win 25% of votes as requirement for winning presidential election.
If FCT is treated as a State; why is gubernatorial election not held rather it's administer by Mr. President via a minister.
I'm ashamed that a lawyer of Falana status exhibit tribal bigotry on a simple phrase in our constitution. Probably he wants to be hired by BAT to get his share of the illicit cash of a drug baron.

Some of you are either outrightly foolish or deliberately mischievous.

Abuja FCT cannot be more than any state of the Federation in status. Its creation is just for the administrative purposes, and its inclusion in that section of the Constitution is just not to deprive its residents of their civil responsibilities else the thirty-six states are the real issue.

Before you start insulting this man, as Nigeria politics is involved, if the 25 percent makes sense, don't you think a candidate that knows he can't win a presidential election will just concentrate all his energy on Abuja election in other to win massively and be a spoiler for the leading candidate not to get 25 percent there so that the election will be cancelled? If it's in that case ,do you think it that way?don't tell me it can't happen?

Many people or young guys and some lawyers are just misinterpreting the Abuja requirements out of sentiments. This case is just no case .
Apart from the uproar it can lead the country to and the cost of running another elections which Nigerian government won't want to risk, this case has been settled during obj regime. No question about it.

The defence lawyers will make reference to it and the case will most likely thrown out. That's how Nigerian court of law works if you don't know. It's only a fresh files that has never been treated as such gets lots of debates.

Lawyers know this, but they are just trying to make money for their pockets. Even tinubu drug case will likely be thrown out. It has been treated before, apart from jurisdiction and timeline of the events.
Just look how dapo abiodun own was thrown out, despite being convicted. Many people don't even know how their country works.
