I don't think the FCT issue is even any strong. Lawyers are politicizing the issue even though the language is clear. 25% in 2/3 of the states and FCT simply means 2/3 of the 36 states and FCT, meaning FCT might complement the number of states to achieve the 2/3.

The constitution didn't say ..."in 2/3 of the states and IN FCT. That 'IN' in bold would have made it care that aside from 25% in 2/3 of the states, a candidate must also have 25% in FCT.

Some people would say ... but the lawyers who argue in favour of the 25% requirement in FCT aren't fools. Of course they aren't fools; it is normal for lawyers to explore technicalities in language to swing a case in their favour even if the implicit meaning of the language or clause is well understood
The point is that it can in all honesty be interpreted either way. Is FCT a state? Technicalities can swing it with a strong argument.

They've done and overdone it so much that they're unaware of how much ground they themselves have lost and still losing.

Many of the erstwhile moderate LP supporters have become irritated and disappointed and have moved on and away from the despicable behaviour and conduct. Only the fanatics remain.

If the election were held again today, LP would struggle to score half of those votes due to the disappointing post election rash and uncouth behaviour.

The constitution is very clear and unambiguous. FCT is one of the state in Nigeria, it's expressly stated in the constitution.

Ab initio, you are told that you need to have at least 5 credits INCLUDING Mathematics and English out of 8 or 9 papers taken to get admitted into a university. That means Maths and English must be part of the 5 credits you get!!

It can't be interpreted either way! FCT shall be considered as a state as regards the provision.

Yes, of course. But it is extremely unlikely in this case. We are talking about a ruling party here. Such wily twist of interpretation would have been more likely if the petitioners are the ruling party.

Whatever explanation or example I'd give will has to be within the context of the subject matter. That said, the constitution says:

...25% in 2/3 of the states AND the FCT.

Neither did it say...

...25% in 2/3 of the states and IN the FCT

Nor...

...25% in 2/3 of the states OR the FCT.

Base on the above, I will explain as you requested. In the first phrase, AND joins the 36 states with the FCT, a territory that has to be mentioned separately because of its unique status. This simply means that FCT might help a candidate to meet the requirement as a part of the sum, e.g., Abuja and 23 other states.

In the second phrase (which is not the case in the constitution), AND IN simply implies that 25% in 2/3 of the states and 25% in the FCT. In this case FCT becomes mandatory.

The third phrase, implies either 25% in 2/3 of the states or just 25% in the FCT.

This is just a normal loophole lawyers explore to back their argument. Such argument can only work if the judiciary is willing to play a wily game of swinging the law in favour of the petitioner on technical ground and who is in the best position to play such game if not the ruling party?

I have studied presidential election petitions and courts judgements since 1999 and discovered that 2023 petitions are the most worthless and useless of them all. It cannot upturn local government chairman election. The petitioners went to court on 4 grounds.
1. 25% in FCT. Supreme Court past ruling, all Nigerians votes are equal and so no golden votes. FCT is just one of states in nigeria as it relate to election and stated in theconstitution.
2. Tinubu indictment of drugs: Supreme Court past judgment, only Court of competent jurisdiction indictment can prevent a candidate. Tinubu was never arraigned or indicted by any court.
3. VP elect double nomination: VP name was never sent to INEC as a Senate candidate. Mere expression of intention is not equal to nomination.
4. Non transmission of results real time: There's no existing law make transmission of results real time a compulsory for INEC.
INEC substantially complied with electoral act.
you are afraid of the outcome. Failure to comply with the INEC law is enough to declare the election null and void.
He was nominated by the party as a senator, he was also nominated by tinubu to be vice president. That is what we called double nominations.

But the problem is that all the tribes are fully represented in Abuja. If the candidate is very popular among all the tribes, there is no way he would perform badly in the FCT since he was accepted nationwide

have you considered the percentage of urban dwellers in Abuja, percentage of christians or muslims or percentage of churches with large followers hip.the basis of your argument is too pedestrian.

Section 299(1) of the Constitution provides that the provisions of the Constitution shall apply to the Federal Capital Territory as if it were one of the states of the Federation. It means that the FCT is the 37th state.

have you wondered why some yorubas in Lagos preferred obi as against yorubas in ondo state.are they not all yoruba?.. you are only focusing on ethnicity neglecting other factors, this is not sufficient.
