If you commit a crime, the court would not free you because your neighbour commited the same offence and was not arrested, even if you present video evidence of your friend committing the crime.

Save that "whataboutist" arguments are not intended for courts but simply to show up the hypocrisy of a particular position in informal discourse. The argument is most often deployed where the very party condemning something is also guilty of it. Like I said - its not for the courts - just to show up hypocrisy.
