I am shocked that of the issues for determination the APC and her lawyers didn't make mention of Tinubu's drug case. Is it a subtle admittance that indeed Tinubu is a drug lord and an exCORNvict. Why will Obi join Atiku in his case did we tell agbado that we are dragging second petition with Atiku?. Meanwhile the electoral act stipulates the submission of members register not lesser than 30days before it's primaries, Congress or convention. It didn't say the party cannot take in new members afterwards. And there is no stipulated penalty for doing so.

You are totally wrong. The inec must do screening of names including verification. Go and read the electoral law. If that is the case, a criminal or drug lord can be approved by Inec then opposition should wait after an election to oppose in court.

“By Paragraph 17 of the petition, the petitioners, on their own, stated that Alhaji Atiku Abubakar came second in the presidential election with 6,984,520 votes as against the petitioners who came third with 6,101,533 votes;

“At Paragraph 102 (ii) of the petition, the petitioners urged the tribunal to determine that 1st petitioner scored the majority of lawful votes without joining Alhaji Atiku Abubakar in the petition.

“For the tribunal to grant prayer (iii) of the petitioners, the tribunal must have set aside the scores and election of Alhaji Atiku Abubakar,

Already,the court of Appeal has made a jurisdiction over this case, so it is dead on Arrival. APC has no case.

I just wish Asiwaju Bola Ahmed Tinubu together with this 10th National Assembly can come up with bloodless modalities to allow South East to go with their five states easily. The noise just too much.

I have read it in INEC regulations and electoral law. It is not the job of INEC to verify certificates and facts of the eligibility of a candidate. The candidates just need to make statements of facts which confirm their eligibility. It is the job of opposition to challenge such facts in court.

I hope you know the Appeal court has ruled on this issue previously in February when APM brought it up.

One of the rulings was that only an LP Aspirant could challenge the nomination done by the LP as a party.
Do you think the same Appeal court(which will constitute the tribunal) will reverse itself this time because Tinubu is involved?

The person who brought that case is not directly involved (lack Locus standi), it does not mean it cannot be brought by the person directly impacted by that decision.

The case you referred to did not go into the veracity of the case, it ruled based on the technicality of the case.

Drug case is 100% not an electoral matter (30 years before election) but Obi brought it because he felt it impacted his chance.

So, pre-election matters can only be entertained as a different case in Court, not in Tribunal.

Both cases can be pursued to a logical conclusion. But Obi's candidature is more of an electoral matter. The Tribunal will admit it based on Section 77(3) of Electoral act.

In Summary, if you say Tinubu does not have any right to challenge what happened to produce Obi for an election as a non-registered member of a party, I will advice you not to believe in the drugs matter too. Otherwise, you will only be talking from both sides of your mouth.[/b]

Obi’s case is dead on arrival. His strongest argument (in fact his only reasonable argument) was that shettima was still a senatorial candidate. When he became VP candidate but he himself was not eligible to contest under Labour because he was a member of PDP 30 days to the primary. Therefore he has no locus standi to even petition Tinubu. The case is dead.

Exactly, that' s what I tell Obidients and even some Atikulators from time to time, and they get abusive. They even call me a tinubu supporter, like as if I like that man.(He is even the main reason why I never vote for APC, and to be honest in 2006, when Gani was going after him in the courts, I was hoping Gani would win, and stop him now and then).

Honestly, PDP was divided in to 4 factions. APC had at least 2 factions, but APC stayed united up till Feb 25, while PDP split into 4 factions. The result turned out as expected. APC won.

Have been following some African countries elections. And the rule is always the same...divide the oppositon, and half the ruling party's work is done.
Plus Atiku was already a tired contender who has little at stake in Nigeria. He wanted a Trophy! Power for its very sake!

There is no need to dignify it because even if he was convicted ( he was not) the case occurred over 10 years ago. There is no need to dignify it with a response because the judges will throw it out without APC having to respond. The judges will ask which part of the law was broken and Obi’s camp won’t be able to answer. For the Tinubu camp to respond, the judge must be satisfied that there is a law that was broken. It is only when you have established that there is a law broken that the judge will entertain your argument and will invite the other side to defend themselves. How can you ask someone to defend himself when no law was broken? I am sure you have all heard of “entertaining an argument” or dismissal in court before a case even starts. Anybody can go to court, I can go to court because I suspect my neighbor is neglecting his wife but the court will only “entertain” my case if 1) I prove I have locus standi ( what is my business, how am I affected am I part of the marriage?). And 2) what law was broken?….. is neglecting a spouse a crime in law?

The law says any conviction that disqualifies a candidate must be within the last 10 years! The court is not a theater for emotion, frivolity and wasting judges time to play to the gallery and score cheap points. No self respecting judge will entertain it. There is nothing to answer just emotional noise.

The 15 SANS that Obinhas gathered know the matter will be dismissed, the whole point of bring it up is for headlines and public consumption, they know the judges will throw it out. Therefore Tinubu’s camp will be playing into their hands by responding.

All these are pre election matters. Just as the double nomination of Shettima. Elections are over. The main bone of contention now is: Did the president -elect meet the Constitutional requirements as to be sworn in? Yes or No.
