Should Nigeria Legalize the organ trade? by Blue3k(op):
I noticed alot of people feel bad for the Ekweremadu's. Currently Iran is the only country where its legal. Ike Ekweremadu was in the Senate when National health act was passed. There's no proof he supported the organ trade until he was caught in the UK. Should Nigeria Legalize organ sales like Iran has?


National Health Act.

53. (1) It is an offence for a person:-

(a)     who has donated tissue, blood or a blood product to receive any form of financial or other reward for such donation, except for the reimbursement of reasonable costs incurred by him or her to provide such donation; and

(b)     to sell or trade in tissue, blood, blood products except for reasonable payments made in appropriate health establishment for the procurement of tissues, blood or blood products

(2)     Any person found guilty of an offence under subsection (1) is liable on conviction to a fine of N100,000 (one hundred thousand naira) or to imprisonment for a period not exceeding one year or to both fine and imprisonment.

I can see that scenario playing out. Human empathy is not why most people obey laws. It's more about deterrents for bad behavior like Jail or a death sentence. I would assume the doctors wouldn't want their medical licenses stripped or thrown in jail like the foolish one that followed Ike Ekweremadu. I'm pretty neutral on the issue.

It would be a brilliant idea.

But the government should use it as a means to encourage medical tourism in Nigeria. Sale of kidneys could be leverage as a draw for many medical services

The necessary legislation would have to be created to make the market flourish and prevent abuse.

People that sell blood are scattered everywhere in Specialist hospitals. You see them hanging around the Lab. Funny thing is they cohort with the lab attendants.

It would definitely encourage tourism. I would like to see this market researched. I have a few questions regarding how many lives it saves and who's lives it saves. I would also like to know how those sets of rules change people's behavior compared to donation only system.

From the looks of the comment section I don't think people would like it though. People sympathize with Ekeremadu's actions but don't want them to be legal for whatever reason.

Black markets exist because commerce in that market is illegal or heavily taxed. There would be little in incentive to have a black market for cucumbers for example. Maybe legalize organ market later is your opinion?

I hope you have never paid for blood or made arrangements regarding that for any of your relatives in Nigeria?

If you have ever done that(i know Nigerians hate donating blood and prefer buying), you've committed the same 'offence', and are equally foolish.

Ekweremadu and the doctor did what typical Nigerians routinely do in Nigeria when they need tissues, blood, organs, etc for their relatives. The only difference is the environment

I have a feeling that if this is legalized ritual killings and kidnappings would go up greatly.

I already suspect that the current trend of ritual killings can act as a smokescreen for organ harvesting for some actors.

He's foolish because he went the UK to facilitate this illegal transaction landing himself in jail. If he went to Iran he wouldn't be in jail and his daughter could be helped. Lastly he was in office when the law you saw quoted was being debated and passed. He never publicly stated he wanted this organ transactions to be legal. This is what makes him foolish.

You liken Iranians to cannibals because they're allowed to sell organs for medical purposes as apposed to donations? I do not get how adding a financial incentive makes it cannibalism/murder. If you find it morally wrong to sell that's fine though.
