Because there is no law against infidelity. You must break a law to commit a crime.

However, one can seek divorce on grounds of infidelity.

Under the Nigeria's Marriage Act, infidelity will only be a ground for divorce if the spouse finds it intolerable. Where the spouse finds it intolerable, the worst the court can do is to terminate the marriage.

The law governing Southern Nigeria (Criminal Code) provides that Adultery is NOT a crime.

However, the Penal Code predominantly used in Northern Nigeria makes Adultery a crime in their parts.

Infidelity can never be a crime because, it is an agreement between 2(Two) adults.

It's high time it's passed into law as a crime and punishable with at least 7yrs imprisonment with no option or fine.
Whoever can't be faithful should remain single for life.
