1.) The DOJ either indicts or declines to indict after an investigation. Declining to indict doesn't mean any criminality occurred. And when they do decline to indict they don't give reasons. In fact Comey broke policy and was criticized for giving that press conference and speaking about Clinton's uncharged conduct.
