The truth is inec never wanted to release all documents requested by LP lawyers to pursue their case that if you actually followed the case but LP too had no agents at most polling units but we're relying a photo shoot of polling results from electorate which they could not present to court.Lamidi papa said it and he was the mole APC use to finish them off. firearcher: |

DMerciful: You need two things for that 1. A new voting device 2. Amendment of the electoral act especially where it related to the EC series documention and their processes. Until then you have automatic accrediting, manual voting, manual recording and manual collation and finally e -display on irev. It's very simple to understand. |

valentineuwakwe: Stop misleading the public, electronic transmission is not in the electoral act. Please show us the pages. INEC said they will transmit electronically, if they can't meet up , there's no crime in that. So far there's no law that mandate them. 1 Like 1 Share |

waveman2: Well, that means they just went out and gambled that they won and never really had the figures to back it up in the first place. Or on what basis will you claim you won if you don't have an estimated figure compiled by your situation room with your polling agents to compare with the ones iNEC eventually released. |

All this judges who claims to be learned are just fouling themself not Nigerians. Bc court do not know that inec is independent when they turned many elections that inec declare A to B. Basing it that inec do not do the right thing Now when it comes to this current judgement all they is that inec is independent to do any thing they want, who is fooling who. About 25per. Of ftc, certificate saga, drug saga, all of them is also independent. No comment |

DMerciful: It is too much to ask because of the intermediate processes. The DC series copies of the EC forms must be given to the police for safekeeping. It takes time. Also the question to ask is why did the final EC forms were not subpoenaed by obi and atiku? That is one of the mysteries my over 40 years at the bar cannot answer. |

DMerciful:You are so intelligent. I told my friends yesterday that; in a bid to uphold that sham election in favour of Apc, the court is setting a negative precedent that will affect majority of these APC members clapping. Going to the Supreme Court will stamp the precedent entirely, if not set-aside.. 1 Like |

tolue42:I am perturbed that the judges at the tribunal sold dummy to you. Here below is what the EA says concerning electronic transmission of results even with penalty if not done. Please check specifically section 60 (5) and also INEC guideline 93. This is the electoral Act quoted verbatim. Section 60 Nigeria Electoral Act 2022 Counting of votes and forms (1) The Presiding officer shall, after counting the votes at the polling unit, enter the votes scored by each candidate in a form to be prescribed by the Commission as the case may be. 'footnote' Note the words "to be prescribed by the commission" (2) The form shall be signed and stamped by the presiding officer and counter signed by the candidates or their polling agents where available at the polling unit. (3) The presiding officer shall give to the polling agents and the police officer where available a copy each of the completed forms after it has been duly signed as provided under subsection (2). (4) The presiding officer shall count and announce the result at the polling unit. (5) The presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the Commission. 'footnote' Pls what are they transferring? Did the commission prescribed any method to transfer the said accredited voters and results of the ballot? (6) A presiding officer who wilfully contravenes any provision of this section commits an offence and is liable on conviction to a fine not more than N5 00,000 or imprisonment for a term of at least six months. 'Footnote' This is the penalty accrued for not following the law and guideline provided by the commission. Section 64 Nigeria Electoral Act 2022 (4) A collation officer or returning officer at an election shall collate and announce the result of an election, subject to his or her verification and confirmation that the – (a) number of accredited voters stated on the collated result are correct and consistent with the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act; 'footnote' Note the word recorded and transmitted. The word is not submitted but transmitted. These are two different words, meaning different thing. (b) the votes stated on the collated result are correct and consistent with the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act. 'footnote' Transmitted directly from the polling units. (5) Subject to subsection (1), a collation officer or returning officer shall use the number of accredited voters recorded and transmitted directly from polling units under section 47 (2) of this Act and the votes or results recorded and transmitted directly from polling units under section 60 (4) of this Act to collate and announce the result of an election if a collated result at his or a lower level of collation is not correct. 'footnote' It is even mandatory for a collation officer or returning officer to compare the recorded results with transmitted results from the above section. (6) Where during collation of results, there is a dispute regarding a collated result or the result of an election from any polling unit, the collation officer or returning officer shall use the following to determine the correctness of the disputed result – (a) the original of the disputed collated result for each polling unit where the election is disputed; (b) the smart card reader or other technology device used for accreditation of voters in each polling unit where the election is disputed for the purpose of obtaining accreditation data directly from the smart card reader or technology device; (c) data of accreditation recorded and transmitted directly from each polling unit where the election is disputed as prescribed under section 47 (2) of this Act; and 'footnote' In this section, it was made explicit that in case there is a dispute in the collation of results, it is expected for the collation officer or returning officer to rely on data of accreditation recorded and transmitted directly from each polling unit so disputed. (d) the votes and result of the election recorded and transmitted directly from each polling unit where the election is disputed, as prescribed under section 60 (4) of this Act. (7) If the disputed result under subsection (6) were otherwise found not to be correct, the collation officer or returning officer shall re-collate and announce a new result using the information in subsection (6) (a)-(d). Section 65 Nigeria Electoral Act 2022 Decision of returning officer on ballot paper (1) The decision of the returning officer shall be final on any question arising from or relating to – (a) unmarked ballot paper; (b) rejected ballot paper; and (c) declaration of scores of candidates and the return of a candidate: Provided that the Commission shall have the power within seven days to review the declaration and return where the Commission determines that the said declaration and return was not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election. The last paragraph is even the cruise of everything. The commission even reserve the right to void an announced results within seven days wherein its detected that the declaration was done against the provisions of the law and guidelines and manual for the election. 'footnote' Breached of: 1. Provisions of the law (both constitution and Electoral Act) 2. INEC guidelines 3. INEC manual so provided The breached of any of these three can render the election null and void according to Electoral Act quoted above. By the last paragraph of section 65, INEC not following its own guidelines make every election null and void as stated above. INEC guidelines for you to read 92. At every level of collation, where the INEC copy of collated results from the immediate lower level of collation exists, it shall be adopted for collation. 93. Where the INEC hardcopy of collated results from the immediate lower level of collation does not exist, the Collation Officer shall use electronically transmitted results or results from the IReV portal to continue collation. Where none of these exist, the Collation Officer shall ask for duplicate hardcopies issued by the Commission to the following bodies in the order below: (i) The Nigeria Police Force; and (ii) Agents of Political Parties 94. Where no hardcopy of collated results is available, the results, where possible, shall be regenerated from the preceding level (Collation or Polling Unit) in accordance with Clause 93 of these Regulations and Guidelines. Now, INEC collated results, they were asked to make them available but went giving blurred results, knowing fully well that a CTC is also tenable in court. I would advise that those aggrieved should go back to court, that is supreme court to test the veracity of the law, if INEC chairman would be greater than what the law and guidelines say. |

Unfortunately, what Nigerians could deduce from this miscarriage of justice by some corrupt judges are, inter alia, as follows: 1. Thrash any guidelines anywhere you go: according to this tribunal: they don't matter even with video evidence 2. 'And' is no longer what it is 3. Don't depend on Nigerian Judiciary 4. Take the law into your hands! 5. .. 6. .. |
