Sylva situation is different from Jonathan situation. Jonathan succeeded yaradua after he died and was elected in the following elections. In sylva case, he came second in gubernatorial primary election that Jonathan won in Bayelsa. So coming out to contest now will go against the constitution which state: A governor can only be elected twice.

In this case,there is a constitutional clash here.The accumulated period sylva has spend in power is 5years, constitutionally he is entitled to eight years max,will he be infringed off his remaining entitled 3years? Only time will tell but I think he has a case here.

The fact that the Appeal court nullified his first election in 2007 means the tenure became null and void, his actual tenure stated running from 2008 when he won the re-run election till 2012
