It's a long ride..and will be a legal battle.

I strongly feel the current speaker backed by the court lacks the powers to declare the seats of the defected lawmakers vacant.

I feel it's the court that should do that...PDP should have taken them to court, instead of using the speaker to declare their seats vacant.

Interesting legal battles ahead...it's possible the 27 lawmakers lose at the court..but, it will take almost 3 years for this legal battle to reach the Supreme Court...of which, they would have successfully completed their tenure and cause damage to Governor Fubara.

It's what it is.

Those opposed to the reasons stated by the lawmakers for their defection should approach the court for judicial interpretation. In the absence of that, they are still members of the assembly unless the court says otherwise. INEC is not going to conduct any fresh election because there is no judicial pronouncement to the effect that the seats are vacant. They remain lawmakers.

Exactly. Only the court can declare it vacant.

The court will declare action of Fubara's Speaker null and void. Wike's members will impeach Fubara and the court will uphold it.

It is the Federal High Court that will nail Fubara.
Go and read section 109 very well. It's the speaker that declare seats vacant. The case of cross river was because the speaker defected as well

Which section of the constitution

Until a court of competent jurisdiction declares their seats vacant, that's when the Speaker can say going by the judgment of the court before him, their seats is declared vacant.

You can't just say it's written in the constitution, they still have to be tried and it's only the COURT that can pronounce their actions illegal and thereby declaring their seats vacant.

Legislatures make laws ....they don't intrepret the law. What if the court says their actions based in evidence before the court is constitutional

You see why a speaker can't declare that seat vacant

Case in point my state , Edo state, H.E Governor Obaseki vs defectors loyal to Oshiomole. They made more noise than this, they went to all media house shouting and grunting like pigs ,but las las in all ended in tears. In Nigeria na sitting governor get power next to president in Nigeria.

Section 109. Go and read it and stop typing rubbish. The case you're referring to was because the speaker defected along with the other members so the courts was needed to pronounce their seats vacant.

Rivers State Assembly: PDP Demands INEC to Conduct Fresh Elections in 27 State Constituencies.
…Insists Defected Rivers Lawmakers Automatically Vacated their Seats

The Peoples Democratic Party (PDP) demands that the Independent National Electoral Commission (INEC) should immediately commence the process of conducting fresh elections into the 27 State Constituencies in Rivers State which have become vacant by reason of the defection of the 27 former State lawmakers in the Rivers State House of Assembly to the All Progressives Congress (APC).

The PDP asserts that by defecting from the PDP, the political Party platform on which they were elected into the Rivers State House of Assembly, the seats of the respective 27 former lawmakers have become vacant by virtue of the provision of Section 109 (1) (g) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

For the avoidance of doubt, Section 109 (1) of the 1999 Constitution provides that “a member of a House of Assembly shall vacate his seat in the House if … (g) being a person whose election to the House of Assembly was sponsored by a political Party, he becomes a member of another political party before the expiration of the period for which that House was elected…”

By reason of the above Constitutional provision and its clear interpretation by the Supreme Court, the 27 defected members of the Rivers State House of Assembly have vacated and lost their seats, rights, privileges, recognition and obligations accruable to members of the Rivers State House of Assembly.

The PDP therefore demands that the Speaker of the Rivers State House Assembly immediately comply with the provision of the Constitution by declaring the seats of the 27 former lawmakers vacant.

In view of the vacancy now exiting in the 27 State Constituencies in Rivers State, the PDP demands that INEC should within the stipulated period under the Constitution of the Federal Republic of Nigeria, 1999 (as amended) conduct fresh election to fill the vacancies.

Our Party cautions that the former lawmakers should stop parading themselves as members of the Rivers State House of Assembly as such would amount to impersonation with serious criminal consequences.

The PDP commends the people of Rivers State for their steadfastness and loyalty to Democracy and Rule of Law especially at this time.

Hahaha, the publicity secretary is being economical with the truth. Why didn't he quote the full subsection of the Constitution provision?

Secondly, what's is the judiciary pronouncement on the issue?

You see, this is the complete version of the section "(g) being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected:

Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or

Let take it further, those members said there is a division in the party as it relate to office of the secretary, it left for pdp to took then to court and make judiciary pronouncement whether there's a faction or not and whether their seat should be vacanted or not and lastly, the speaker didn't have the constitutional requirements to hold the plenary talk less of declaring their offices vacant in process.
