No, the law did not prescribe for their action to be declared illegal before their seats can be declared vacant. You are just like saying; a court must declare A criminal before he can be arrested for killing B.
There is a case law that already made their act illegal, the onus is now on them to go to court to prove their action was not in contravention of the law. They will not because they know they are wrong and it is the reason the president and his party don't even want to go down that path.

There is a case law that prescribes that when you abandon the platform upon which you were elected for no judicious reason, your seat becomes vacant. Our electoral laws only allow you to vote for a party and not individuals so what they have done is taking what belongs to the PDP to another party for no justifiable reason according to law

these are the people who have turned our judges to yes daddy, whenever they as u to go to court have it in mind that the judgement have been writen down by them no matter the stand point of the constitution they dont care. Ahmed lawal comes to mind. We don't have court anymore under this regime

I said something like this when I read about the directives by Mr President.

I said the president thought he is dealing with Fubara directly by issuing such one sided directive he called intervention. He forgot that this is no longer about Fubara, it is now a party thing between APC and PDP, and nothing can be done to help the detectors. Even if you remove Fubara through the supreme Court which is a hard nut to crack, that won't still bring the detectors back to their seat, they are gone for good , except they recontest, and they will never win

The lawmakers were stupid to have defected, if Wike advised them then it was a miscalculation on his part. Even if Fubara will not has no direct business with the law makers defections, Tinubu can not ask PDP as a party not to take the law makers to court and declare their seats vacant, that's beyond Fubara. So the law makers if fact APC may not give them the opportunity to represent their party, because they already had members who contested those positions before.

why are you people so stupid? The law gives the speaker the eight to declear their seats vacant, if they are not happy with it then they should go to court.
Today Akpabio declared 2 seats of the senators vacant, is it the court that deleared vacant?
The constitution has given the power to the senate president, speaker of reps, speaker of state assembly the right to declear their seats vacant and it has already been done.

I don't even understand the point you are trying to make. You are just making attempts to use cases of disregard for the law to justify another wrong.

First paragraph: the power to declare a seat vacant in the legislature rests with the Speaker or whoever that's the presiding officer, if a lawmaker defects in contravention of the law or for absenteeism. The Supreme Court already resolved that in the celebrated case of Oloyo v Alegbe (1983) N.S.C.C. 315 in the judgment delivered by Justice Kayode Eso.
The case law provides that the Speaker or the House may seek a court action, he does
not necessarily have to seek such action before enforcing the provision of Section 109 of the Constitution by excluding the member from the House . A legal dispute only arise after the seat of the lawmaker has been declared vacant and it is the person who is aggrieved that should seek remedy in court.

Other organs of government are not bound by law to wait for judicial interpretation before they can perform their functions of applying the law. There is a reason there is the "instrument of judicial review". Where it is proven other organs of state acted outside their power, the judiciary declare it Ultra Vires and status quo is maintained.

Second paragraph: Ifeanyi Uba's seat not declared vacant by the house does not mean it is right and it is not right for you to use it as a parallel either. He only survived because he defected to the ruling party and the Assembly management decided to look the other way, thanks to our culture of brazenly disregarding laws in Nigeria. The YPP did not complain because they consider Uba to be bigger than their party and it doesn't still make his action right.

Paragraph three: you said a criminal arrested for an obvious crime still needs to be convicted by a court of law. This your reference is only agreeing with me. The obvious crime here is the defection of the lawmakers for no judicious reason, the arrest of the criminal here is the Speaker assuming his responsibility to declare their seats vacant, so they can now approach the courts to seek interpretation if the parties acted within the law.
There is a judicial precedent (court pronouncement) over defection so I don't understand what you mean. Section 103 and other case laws did not say there must be specific pronouncement for every specific defection before action can be taken.

Paragraph four: if the courts determine their defection is constitutional, they will be reinstated with full benefits.

Last paragraph: I don't understand what you mean by the speaker made that "Illegal Pronouncement". The speaker relied on an established law to make the pronouncement. You are not a judge/law court likewise myself to term it illegal.
The affected lawmakers should go to court.

Nigeria is really a lawless country, same thing Buhari did is what the current president is doing too. In a bid to solve a problem, we disregard the law to do whatever we want. Like the president "ordering" for the former speaker to be reinstated and people find it okay. I'm sure YOU will use this as a future reference just like you did with Uba.
The president lacks the power to reverse a judicial pronouncement, only a superior court can but our president just gave an order against what a law court pronounced "authenticating" Ehie Edison as speaker

This was supposed to be a party affair that they should have resolved. They failed. They have no control over Fubara, Wike and house of assembly.

On the 30th of October 2023
In a session that was presided over by the Speaker of the 10th Rivers State House of Assembly, Rt Hon Martins Amaewhule and attended by a good number of members, the Leader of the House, Hon Edison Ehie and those loyal to the governor were suspended. And a notice of impeachment was served on the governor of the state Amaopusenibo Siminilaye Joseph Fubara

However, the state governor came out to ask the reason for his impeachment to which they have not answered till date.

However a lot of waters have passed under the bridge in the past few days. With accusation and counter accusation.

It will be recalled that even the main auditorium of the hallowed chembers was burnt by unknown individuals a night before the impeachment notice was to be served.

Of the 32 members of the Assembly 27 are strong supporters of the FCT
minister in the course of carrying out there treat have decamped from the PDP to join the APC.

The remaining 5 members who are also believed to be supporters of the Gov. Sim Fubara have elected Rt. Hon. Edison Who's as the new speaker of the 10th Rivers State House of Assembly, and has since been recognize by the governor.

However the Crux of the matter is the insistence of the decamped 26 members led by Martin's Amaewhule to continue their plot of impeachment.

While the Rt. Hon. Edison faction has since declared the seat of the decamped members as vacant and see them as automatically not members of the house again.


It will recalled that in 2018, when the then Governor of Zamfara State, Governor Bello Matawalle decamped from PDP to APC, Wike was threatening fire and brimstone that he should vacate his office in line with the constitution.

Wike used the same strategy on Dr David Umahi of Ebonyi State and his Cross Rivers State counterpart Ben Ayade when they decamped from PDP to APC.

“The constitution is clear and the law must be adhered to and going by that, the decampees have lost their seats at the state legislature, it happened in Cross Rivers State so all the noise about the ex-lawmakers in Rivers State is a noise of no value,”


It will be recalled that in the Cross Rivers State Assembly case The lawmakers defected alongside the Cross River State governor, Ben Ayade, on 20 May, 2021, triggering a lawsuit by the PDP on August 27, 2021.

In arguing its case, PDP’s lawyer, Emmanuel Ukala, a Senior Advocate of Nigeria (SAN), sought the court’s interpretation of the provisions of Section 109(1)(g) of the constitution, which prohibits a lawmaker from defecting to another political party without justifiable reasons.


Mr Ukala also drew the court’s attention to the decision of the Supreme Court in the case of Ifedayo Abegunde versus Ondo State House of Assembly (2015).

He contended that the lawmakers being persons whose election to the parliament was sponsored by the PDP and having become members of another political party, their seats should be declared vacant.

In delivering his judgment on the case the trial Judge Taiwo Taiwo
noted that “the lawmakers wined and dined under the umbrella of the PDP,” but ditched the party even when there was no justification for their action.


The case of Cross Rivers State House of Assembly is what is exactly playing out in Rivers State.

Therefore Rt. Hon. Martin's Amaehule and 26 former members of the Rivers State House of Assembly have successfully impeached themselves in their quest to impeach the Gov. Sim Fubara

INEC should do the needful to conduct an election to fill in the vacant office.
In your bitterness against Wike you forgot to research on what the law says about detection and its process. Are you the senate President or speaker they wrote their detection notice to? Do you have the letter of their detection? If 27 of them defected the remaining do they have the quorum to declare the seats of the defectors vacant?
