Former President of the Nigeria Bar Association (NBA), Wole Olanipekun, SAN, on Wednesday, said ex-President Olusegun Obasanjo almost punched him when he advised him to amend the country’s constitution during his administration.

Olanipekun described the 1999 constitution as “fake” and lacking the required elements to address the various challenges confronting the country.

He called for the total overhauling of the constitution.

Olanipekun spoke delivering the 32nd and 33rd convocation lecture of the Olabisi Onabanjo University (OOU), Ago-Iwoye, Ogun State.

He delivered a lecture titled: “Mass Exodus of Human Capital in Nigeria: An Anatomical Analysis of the Causes and Effects”.

He legal luminary blamed insecurity, faulty constitution, bad economy and “awkward” federalism for the mass exodus of young Nigerians abroad.

Olanipekun said as the President of NBA in 2002, he led a delegation of members of the association to meet Obasanjo where he advised him to commence the process of amending the constitution, but the former President not only rejected the advice, but almost “boxed” him.

He said “We need a constitution with a humane face. I’m a lawyer, but we are deceiving ourselves, our constitution is fake and I have said this over and over, but then you will ask we lawyers that, ‘if we say the constitution is fake, why are we practicing it’? Lawyers and judges apply the law as it is, not the law as it ought to be, so we apply the law as we have it now and we have been pleading that we should amend the constitution, let us overhaul it.

“I, as president of the NBA, I led a delegation of the association to president Obasanjo in 2002, he almost boxed me, I’m here in Ogun State and I’m saying this, he is still alive, he said ‘no you can’t change it’, I said Mr. President, let us seize this opportunity to do it.

“We also appeal to the powers that be now, to our president, Bola Ahmed Tinubu that the time for us to restructure this country is now if we do not do it, these children that we have abroad might not return home, they won’t come here”, Olanipekun said.

He described previous alterations to the constitution as “charades and widow dressing” and called for the restructuring of the country.

The legal luminary blamed insecurity, faulty constitution, bad economy and “awkward” federalism for the mass exodus of young Nigerians abroad.

Nigerians are leaving in their numbers simply because they have lost hope in the country. Nobody wants to leave their comfort zone, but when your comfort zone isn't comfortable anymore, you have to find a way to help yourself.

You shouldn't be asking anyone this question.

In 2017, APC set up a restructuring committee headed by El-Rufai. Among other things, the committee recommended resource control by states and the creation of state police. Buhari didn't implement the report.

Surprisingly, Tinubu, who has campaigned for true federalism all this political life, doesn't care anymore. APC is a cancerous lump on Nigeria.

You tried to sound intelligent but only showed how unimaginative you are.

If the sitting President is against restructuring can the Assembly and others do it on their own??

The President can veto any bill and it will die on the vine

That you cannot grasp that a sitting President is the ONLY person who can initiate the process, calm all objections and frayed nerves and keep pushing till it's done.

That you are blind to the fact that the APC is the majority party therefore it will be easier for Tinubu to get it done and that a strong President can push and pull much more weight than a weak President like Jonathan.

That you must be too young to remember that Tinubu has been a vocal advocate for restructuring for well over 20yrs before he became President.

Tinubu will NEVER support restructuring until he and his party are no longer in power. Restructuring will make Nigeria better but as a side effect-weaken the centre.

He won't support that till his party is out of power

Let me rest by saying you don't have to always pass comment on every political issue like you are some kinda sage when you can't even see the blindingly obvious.

You are even more myopic. When Tinubu was asking other presidents to restructure the country, was he also myobic? You and I know that the President has a lot of role to play if this must happen because of the kind of constitution we run. "What kind of nonsense?"

OBJ had the chance to make this country work, but he blew it. He's part of the reasons we're still here. If OBJ wasn't corrupt and selfish, he'd have been our best.

He could have taken that advice to amend the constitution, but he knew the existing one favors him more, hence his reluctance to kickstart an amendment.

He organised a political conference in 2005 and dumped the report.
