You cannot give what you don not have. E money is to blame , no other way about it. He should make amends asap because if this gets to the court he will suffer more apart from the reputation damage to him

Not true,
1 the client failed to honour his commitments for 2 years plus.
2 the vehicle can be termed a collateral to protect Emoney business if the client defaults cos more like Emoney loaned them his own funds using the cars as security.
3 he can argue that his terms allows him to forfeit items not claimed after a specific period due to owners failure to honour their financial commitments. (Lots of companies do this)

4 if you were E-money and you borrowed funds to Clear a vehicles at 35% interest, hoping to get your money back and profit within a month, 24 months counting, no money and interest piling up, what will be your survival instinct?

Don't mind him!
Then, a dollar was approximately 650 but now, 1,450 to a dollar is a serious debt. 1.2B of then is like 4B now.

And the company is even insisting they don't want money but their cars!

It's too early to take sides until we heard from E-Money himself, someone can't just sold cars that are meant to be cleared without proper channels,,that's deceit and fraud which I believe he will desist from so as not to damage his reputation as a good business man.

You really assume one is a good business man when you've not even done business with him? Lol

You gave someone contract to clear vehicles for you and paid a fraction of the costs

He cleared it successfully and kept it for you in his warehouse to pay up the balance and collect your property

You defaulted and didn't pay the balance

The vehicles were kept in storage from 2021 till 2024, blocking useful space and attracting heavy demurrage fees which you also couldn't pay off

Now vehicles were auctioned off to cover for delayed and accrued service and demurrage costs

You vex go call police undecided

Okay, let's see how this case ends cool

No where in this write up did I see that only a fraction the cost was paid. Be that as it may, e money said he's going to tell his own side.

If Emoney does not have documentary evidence for his actions. If he has no documentary consent to sell the goods of his client, he will be in deep trouble.

It sounds like a challenging situation indeed. The cost of clearing vehicles in Nigeria's ports can be exorbitant, sometimes surpassing the vehicle's purchase price. Emeka's predicament with the abandoned vehicles highlights the complexities of business dealings, where commitments aren't always honored. In such cases, legal recourse seems inevitable, though a settlement appears to be the likely outcome given the mutual breaches. Emeka's liability should reasonably extend to the vehicle's original cost plus inflation over the two-year period. Interestingly, had the vehicles been left with Nigerian customs, the outcome would likely have been far less favorable. This underscores the importance of prudent decision-making in business dealings. The involvement of car wreckers could offer insights into alternative solutions for handling such situations effectively.

Oga, even if someone owe you as you explained in this money car clearing case, it does not give you the right to go auction off the vehicles or goods. There are legal processes to follow. Even if you have it in writing that within a certain period your goods will be sold off, you still do not have that right. Only the courts can give you permission to sell and recover your money.
You may not realize it, but what this people are doing now is to create a proper case for legal action in which they will seek for many times that 1.2b.
Fine, settlement can be reached at the police, but I doubt that is their main focus. Litigation is what they are after. Emoney is a good litigant, because he has fixed assets that can be chased in event of claims been awarded.

Police said it's a case of criminal conversions but the matter is being handled by the anti human trafficking unit, what's the correlation here, this case is dead on arrival at the courts, see how Nigerian police bungle cases? See what the efcc chairman did in GYB case where he resorted to media trial and has now completely gone grave quite when he realized his folly?
Re: Police Probe E-Money Over N1.2 Billion Dispute With Lagos Firm by Satazaa: 11:21am On May 09

Cost of clearing a vehicle in Nigeria ports sometimes exceeds the cost price of the vehicle at purchase. It's a clear case of breach of contract by both parties.

Client abandoned vehicles with Emeka after he has committed his own money to paying for clearing the vehicles for more than 2 years. (All this are obvious in the press release)

No business man will tie his funds down on another person's business for that long (2 years plus) without any sign the other party will meet up with his payment.
If this case goes to court, na settlement go end am. Cos both parties are in the wrong.

My personal opinion is Emeka is only liable for the cost of the vehicle at the point of purchase with accrued inflation on the value for 2 years. If he had left the vehicle with Nigerian customs, the owners will have no case at all cos it would have accrued so much demurrage or auctioned.
did he get a court order before he sold them off or did he sent a written letter to the owner before he auctioned them? is he a licensed auctioneer? did he remit the outstandings to the owner after his legitimate deductions? was the representative of the owners there when emoney was auctioning? In saner climes this emoney would have been cooling his heels in jail right now

That's the value in 2020. It's now 4 times that amount and they want their vehicles and not the money.

Do you work for him to know all these? Okonkwo never talk im side of the story, where you get your own?
1. Did Okonkwo sign a legal document with his own Lawyer before selling the cars?
2. If at all anybody's property is occupying any space, why did he call his Lawyer to sign a Legal agreement with the Car dealers to take the vehicles and pay him on a stipulated day after selling the cars?
If they don't pay him and he is aware they have sold the cars, then he will sue them.

He is very foolish for selling anybody's property on such a foolish ground. Now, Bush meat don catch hunter, they have demanded for the vehicles, not money, so he will have to pay more.

E money is bigger than 5 billion naira. Guy! This isn't even an argument.

What is happening here is just a big mannarism. This is how most Rich men and women behave in Nigeria, but when they travel abroad they live and behave like a commoner.

It is in this country, you will see a billionaire worth over 50billion, refusing to pay you for a job of just 1.5million. he would rather bully you, or pay police 10milion to bully, than for him to pay you.

Too many wicked people in this country who don't want others to grow. I don't blame those who leave this country.

[b]“In this business, it is after an agent supplies that you pay and he has not even supplied any of the vehicles.

It is not in all case, it depends on the contract agreement between the consignee and the clearing agent. There are contracts in which the clearing agent has to use his money to finance the whole process of clearing of the goods and awaits payment after delivery. Also, there are agreements in which the consignee foot the bills, that is make money available for payment of custom duty, shipping charges, terminal charges, then on or before delivery pays the clearing agent his agreed service charge.

Assuming what you stated is what happened, do you not see how E-Money is clearly guilty? Is there an agreement for him to auction the goods or did he get a Court order to do so? Have you not seen cases where Landlord cannot simply break door and remove the properties of a tenant whose rent has expired without a Court order?
