Stop speaking with ignorance, when the appeal court reinstates Rt. Hon. Martin Amaewhule 26 orthers, all decisions by the minority faction of 3 becomes Nulity including all nominees they have approved for the curious young boy called fubara, Now the Rt. Hon. Martin Amaewhule 26 ors will now extend the duration of the LG chairmen and sack the jokers fubara appointed yesterday ...Yawn
Are you saying the state lawmakers can make a law that is contradictory to the constitution?

Justice kio has ruled it UNCONSTITUTIONAL. Take it to appeal then supreme court, its still unconstitutional. Those Chairmen are gone paving way for the governor to install his men. That's the game. As it is , the 27 lawmakers can't bring them back. So what's the way forward?? 😂
Let me make it easier for you to understand. Fubara sent the CTC list to the state House of Assembly led by "factional Speaker," Victor Jumbo, on Tuesday.

If it happens that the 27 lawmakers triumph in court, it would be deemed that all the actions of this current assembly led by Jumbo is a nullity. This includes the confirmed CTC list, commissioners and other appointments.

Like I told you, there is a FHC Order from Justice Omotosho's court recognizing Amaewhule's assembly. This is the law by virtue of Section 272 (3) CFRN 1999 as amended which hold that it is "only" the FHC that can determine whether or not the seat of a State House of Assembly member is vacant. This order has not been vacated. It is still subsisting.

The judgement that derecognized Amaewhule's assembly emanated from a State High Court which lacks jurisdiction by virtue of the subject matter.

I say all these to say that the matter still tie big wrapper. The matter go reach Supreme Court.

any judgement between Fubara and the former lawmakers is completely irrelevant because the house if assembly members that the governor recognizes are the people he will work with, we may end up having two houses of assembly in rivers state, The rivers State House of assembly and the supreme Court House of assembly, while the former will be making laws for the state, the later will be making laws for themselves, Fubara will never work with those fools again, and for those that are dreaming about state of emergency, the ijaws will rather die than see Fubara being removed as governor.
You have said it all.. I doubt if those foollls will have anywhere to sit for legislation again as they will be denied access to government house.. They will be making their laws from Abuja just like Obaseki did to Oshomole loyalist.. Don't underestimate the power a governor has in this country

When they finish extending it, I hope it is the law makers that will give the chairmen funds to carry out their duties as chairmen? 😂

It is the perogative of the governor to appoint commissioners.

The house cannot sack any commissioner. It is a legislative function.

Even the caretaker committee, he can appoint without the house.

Can they impeach him?

Yes. But on a serious basis of misappropriation.

Only on that sir!

ZIAZI:
God bless you, my brother. It shows that you really understand the law. If Amaewhule's assembly is confirmed, it will be over for Sim.

The CTC guys as well as all the commissioners will be out. These ones parading themselves as lawmakers will be suspended again! Mind you, they were already suspended by Amaewhule even before the issue of defection came up.

The matter never even start. I am not bothered about the LG Chairmen. Na Assembly I focus on.

go and look at those appeals being heard. Some are between the LG Chairmen and the State Government. They are appealing against the settings aside of the LG amendment law that was passed by the HOA.

The Supreme Court is going to rule on that. The LG funds will be paid directly to the Chairmen if the Supreme Court rules in favor of the prayers of the AGF.

It's not alien to our constitution, oga.
It was merely domesticated at the state level to promote smooth transition of power at the LG level.

It is a beautiful piece of legislation.
A state can only domesticate what the National.Assembly has passed into law and the NASS can't pass into law any bill which provisions runs contrary to the constitution. There's no provision for tenure elongation in the 1999 Constitution as amended and the NASS has never even contemplated anything like that.
So where is the Amaehwule and his 26 co-travellers getting the thing they're domesticating?

Re: Court Of Appeal PH Sitting 20th June by phantom(op): 3:51pm On Jun 20, 2024
It’s baffling where some of these “data boys” are getting their information about court rulings because the appeal case is far from over.

As of today, Martin Amaewhule's lawyer, Ken Njemanze SAN, withdrew the second prayer of one of his applications. He then requested permission from the court to file a new application tomorrow, Friday, June 21, 2024.

Sammie Somiari SAN, the counsel for the 1st Respondent (RT. Comr Victor Oko Jumbo), insisted that if Amaewhule's lawyer is allowed to file a new application tomorrow, the court must also give him time to respond.

The appeal case still has a long way to go, but these leaders won’t tell their “data boys” the truth. Instead, they deceive them with lies, claiming the court will rule tomorrow.

This shows why being in the opposition isn’t an easy game at all.

a court has ruled that tenure extension as illegal, those local government chairmen are gone for good
The same court that ruled that failed to realize that CTC is also illegal and alien to the Nigerian Constitution.
If the Hon. Amaehwule and 26 others are reinstated, then those former LGAC chairman will be reinstated pending when the governor truly intends to do the election and if the Court in Abuja goes in favour of the Attorney General/FG for LG autonomy and preventing States Electoral body not conducting elections then INEC will be funded to do such days by the FG.

Enyiada Cookey-gam and ors sued the Governor asking the court to order him not to obey any law amended or repealed by the former speaker Martin Amaewhule, one of those laws is the imaginary tenure enlogation.

How is that possible? A court has said that the elongation law is hereby squashed. What is difficult to understand. If the lawmakers come back, that law IS NOT COMING BACK WITH THEM.

As for the legality of the CTC, you can as well challenge that in court.

It would be a waste of court process to do such as it stands now. The FG will not be sending forth LG funds to States having CTC in place. They all will have to conduct proper elections.
