By the way, any landlord that waits for a tenant's rent to expire before issuing a notice to quit is working with a BSc lawyer.

The law states that a notice to quit should expire on the eve of the rent's expiry date. So it is in order to issue a notice to quit when a rent is running.

Once you pay, refuse any refund bc you have a right to stay the full tenure of your rent (for those that get served notice to quit that expire with months remaining on their rent.)

Whatever the court grants you, you must still pay mesne profit.

That the person didn't pay and pack out is because the landlord either doesn't know the law, or he doesn't have strength to track down the runaway tenant.

The landlord involved in our case is a powerful and wealthy king.

7 block of flats, and wanted to evict everyone forcefully, we took him to court and court granted us 6months, and when the 6th almost elapsed, we pleaded for more time to vacate, the court gave everyone 3months, and after that, another 1 month was given.

We no pay 1 naira.

And you are now providing more details.

Landlord has no right to FORCEFULLY evict any tenant outside the provisions of the Landlord/Tenant Agreement, and in absence of this, the particular state's Tenancy Law.

So if the landlord is acting unlawfully, the tenant has a right to seek legal redress, and the court has the right to effect any judgment (punitive or not to either/both parties) as it deems fit.

Your case is different and your initial comment didn't help in understanding it.

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

After staying 2 years in an apartment, my rent expired exactly August 1st, 2024 and after expiry landlord reached out for his money and I politely told him I’ll be moving out and I need some time to secure a new place before parking my load out of his house, he then asked for how much time, I told him maximum by middle of September (next month) I should have gotten a new space. This man then told him I’ll have to pay him for 2 months that is august and September and I’m like how possible? I just told you I need some time to move my loads and you are asking me to pay? Okay I didn’t want to argue so I should stopped the conversation and left politely.

So my question now is, what should I do in this case?

Please bear in mind that when I got this apartment, he collected legal fees and I was never given any agreement form to sign.

I honestly don’t want to pay him any dime. What can I do? How best can I approach this.

You are to pay, he has done nothing wrong legally by demanding for payment. If he let it go it's his discretion.

You're talking nonsense. I threw out a tenant this year in July who was running his mouth like you. It took 4 months only here in Abuja.

Please help out....
Our landlord lawyer came in today and said he has increased the rent and is giving everyone quit notice....our rent is due to expire next month... please his he righthuh
The last time he promised to increase the rent he said he will Fix bore hole which he did not do and the documents he brought for us to sign we don't somethings there and he didn't come back for explanation.....what should I do??

You really needed to write your own law books. Those are misconceptions most laymen have and from my 16 years as a lawyer I can tell you most persons are as unaware as you are that that is wrong.

Notice to Quit is ideally given to expire on the same day as your rent expires. It is called "the anniversary of the tenancy".

The idea that you cannot be given a notice to quit while your rent runs is not only wrong but suggests you think, like some also do, that there is this free rent period a tenant is entitled to as he is given a quit notice. No, there is none.


In fact, even if you overstay by one day without the agreement of the landlord he can recover through the court rent for those days you overstayed. It is called "mesne profit" or "use and occupation" in law. Check it up.

The notice can START at anytime, the only thing is that it must END on the same day rent expires or after that but never before that day.
Hello...A tenant that refused to renew his rent, owing the landlord for like 2 months is entitled to how many months notice to quit..This is a yearly rent property

Get a property lawyer.
Then, let the lawyer serve him notice of the owner's Intention to recover the premises. Also, let the lawyer go to court and institute an action to recover the premises.

Please a quick question.

Can a tenant claim damages for any renovation work after his rent has expired?
He was notified 6month before expiration of rent and also notified about commencement of renovation after the expiration of rent.

He’s stayed for over a year now without paying and also instituting a court case for theft in his room because the verandah burglary was removed in order to commence renovation. This happened like 3 months after the rent has expired.

He also obstructed the renovation of the property’s fence.

You are not getting it, how can you expect him to park out just at the expiration of his rent?
Why not give him an extra 3 months' notice, the 3 months' notice will start counting from the day his rent expires.
You can only appeal to the Landlord for the extra 3 months. The law only requires the Landlord to issue 6-months notice for a yearly tenant.
