The Court of Appeal sitting in Abuja affirmed the earlier judgment of a lower court which nullified the passage of the Rivers state 2024 budget by four members of the state assembly.

In a judgment by the three-member panel of the appellate court, led by Justice Joseph Oyewole, the panel held that the appeal filed by Governor Simi Fubara against the January 22 judgment was unmeritorious.

Justice Oyewole, the lead Judge, while nullifying the passage of Rivers State’s N800 billion 2024 budget by four members of the House of Assembly added: “Having failed to challenge the case at the trial court by withdrawing all the processes (documents) he filed against the suit, he cannot turn around to now seek to appeal the judgment.”

APC has flooded the judiciary with "Yes Judges", and this has emboldened them to be using the Nigerian courts to basically terrorise the people non stop. Not even during the military regimes have we seen this kind of brazen assault on the judiciary. Using judges and judgements so openly to underwhelm the opposition in a so called democracy , is a direct route to disaster.

The only thing that has kept the faith of the people on this democracy since 1999, is the belief that there is a court somewhere, and a judge somewhere, that are willing to do the right things and call things as they are. Once you remove those, what we have is a dictatorship as draconian as that of Abacha. And to think that the the presidency is headed by the same shady characters who fought Abacha to a standstill in the name of "fighting for democracy", simply rockets the irony to neptune levels

You are asking for "empirical facts" when Wikes wife was just appointed a judge? And a man who came last in an election was made the governor in an election he openly and thoroughly lost? When the last supreme Court chief justice was appointing his relatives to sensitive positions? Openly! When buhari waylaid the supreme Court judges with all sorts of blackmails and arrests? When the APC has beeen appointing their lackeys to the court of appeals for years now?

The judge gave judgement base on the facts before them.

The PDP claimed the lawmakers are still PDP members, what do you expect the judge to do?

The supreme court might give judgement on the issue before then, and if there's no judgement by then, before March, the supreme court will deliver a judgement, if it's in favour of Wike's lawmakers, then the budget will become illegal, he will be asked to present a new 2025 budget.

And there's still 2026 and 2027

See ..

There are loads of bottle necks...

Let's assume the seats of the defected lawmakers are vacant...

What did this constitution says about steps to be taken for the State house of assembly to form a quorum?

They will have to conduct new elections to fill those vacant positions first, before the State house of Assembly can be seen to have tge numbers to form quorum.

5 lawmakers cannot be legislating ....It's illegal.
