An Ado-Ekiti Magistrate court on Wednesday remanded a Lagos based human rights lawyer, Dele Farotimi over an alleged case of defamation against Aare Afe Babalola SAN the founder of Afe Babalola University, News360 Nigeria reports.

Farotimi, who was arrested at his chamber in Lagos on Tuesday by officers from Ekiti State Police Command, was arraigned for allegedly publishing a book “Nigeria and it’s Criminal Justice System where he alleged that Aare Afe Babalola corrupted the Judiciary and procured judgements in the supreme court there by exposing him to hatred, contempt, ridicule and damage his hard earn career.

The suspect Dele Farotimi pleaded not guilty to all the sixteen count charge.

Police prosecutor, Samson Osun called for the remand of the suspect in prison custody pending further investigation and it’s outcome for the maintenance of security in the country.

Counsel to the defendant, Dayo Akeredolu opposed the remand call and pleaded with the court to admit the defendant to bail on very liberal terms and on self recognisance because the case at hand is bailable and the suspect is a known figure who is not constituting any threat .

He said the defendant is presumed innocent until proven guilty.

In his ruling, the presiding Magistrate, Abayomi Adeosun remanded the suspect in prison custody and adjourned hearing till December 10.

This should have been a civil matter, in a civil court, between Farotimi and Babalola

The Police should not have been part of this

If you feel someone has defamed you, sue for damages in a civil court, not criminal court

He’s going to familiar territory and will get enough material for his next book which, he will, hopefully, write with some common sense and the benefit of some semblance of home training! He needs some correction!! Prison looks good on him.
Folks raising hell against Aare Eniafe Babalola on the matter will do well to educate themselves by reading the academic article below. Clearly the Supreme Court is put in public ridicule here. This matter is beyond an individual. The Learned A.G. of Ekiti State should prosecute this matter to its fullest extent. It should develop our body of Laws on criminal defamation to help underscore the fact that the right to free speech is not tantamount to a right to malign the character and person of others whether institutions or individuals.

Deformation is a civil matter na... So why arrest him and remaned him in prison

This right here is the worst a Nigerian big man can do... Use court put u in prison till your bail is granted... They just use the fact that most Nigerians are scared of going to prison

Once they know u are not scared of spending a few weeks or months in prison they become powerless verydark man is an example

It is very simple , the case is bailable , he will be granted bail at the next hearing , but if he has any proof about all the allegations he made against afe Babalola then he should present it to the court and Nigerians when the case finally gets on

As a senior lawyer, I wish to state categorically that the Allegation are weighty and its a criminal defamation case and not a civil matter.

Hence the involvement of the police is justified.

It is left for Bar. Dele to defend himself with strong evidences and not hear say evidences.

Those who Dele has defamed in the passed and all toes he has stepped upon will cease this opportunity to get at him.
