Minus the intelligence from US, the Ukraine heavy guns, artillery , anti air are silent. This is really a world war , I had never looked at it that way I remember once Russia threatening an American Orion spy plane over black sea and on another instance crashing into a predator drone. Legally speaking, Trump and the DOJ have the right to do so, as any other defendant in a lawsuit, and the judges have discretion in granting/denying such requests.

However, this looks like a not so subtle ploy to discourage future litigation against the federal government because, for instance, not many plaintiffs would be able to pony up millions of $$ or even hundreds of thousands of $$ that could potentially be demanded by the government attorneys.
