1.) That is exactly one of the reasons the government says they detained some of these peoples.
I already linked the ICE procedures.

2.) That is not how any of this is supposed to work.
The government is supposed to affirmatively prove why they are detaining you.
And they are supposed to prove it to the courts.
That is the point of due process.
No one has to prove their innocence.
