In case you are not aware, your laws in Lagos have to be in compliance with the Laws at the National level. The clause that somewhat excuses rape in marriage exists only in the legal definition of marriage in Northern states of Nigeria.

Precedents do not trump the details of the Law. The law is what is instead meant to be sacrosanct in any society. That is why even when dictators take over, they find they need to change the laws to completely disarm opposition.

➜Law is only as good as to how much extent it is enforced. Come to think of it. In all such cases of marital rape in any court in Nigeria, the cases come under marital dispute in Customary Courts, and not as a criminal case In a magistrate/High Court.
