A U.S.-born American citizen was being detained at the request of immigration authorities Thursday despite an advocate showing his U.S. birth certificate in court and a county judge finding no reason for him to be considered an “illegal alien” who illegally entered Florida.

Juan Carlos Gomez-Lopez, 20, was arrested Thursday evening by Florida Highway Patrol and charged under a state immigration law that has been temporarily blocked since early this month. Details of Gomez-Lopez’s arrest and detention were first reported by the Florida Phoenix news site.

After inspecting his birth certificate, Leon County Judge LaShawn Riggans said during the hearing that “this is indeed an authentic document,” but that she did not have jurisdiction beyond finding no probable cause for the charge.

Immigration and Customs Enforcement’s role is to enforce immigration laws that generally apply to noncitizens. American citizens are protected under the Fourth Amendment of the Constitution from unreasonable search and seizure, arrest and detention.

Nonetheless, he remains detained locally at ICE’s request, said Thomas Kennedy, a spokesperson at the Florida Immigrant Coalition who attended Thursday’s hearing.

“Everything tracks for him being sent to an ICE detention center,” he told NBC News in a phone interview.

Honestly, stuff like this I'd rather have one Fed. agency control it. If they choose they can contract some of it out to the states. I want to be comfortable going to any state knowing the standard is consistent.

CA is not the only state in USA. Many states can't afford it, and repeating inspections state by state costs a lot more.

True for California, New York, Texas (maybe), and other big states. But those other states that are often in the red and have been consistently subsidized by us will fall behind.

And unfortunately, diseases do not understand state lines. If some food borne communicable diseases like norovirus or typhus breaks out in one of their poorly run states, it will get to us even if our food quality is top notch. All it takes is for someone to attend a work conference in another state, eat a salad for lunch and bring back a trail of gut pathogens from the airplanes to the public transport and back to us. 🥲

Also some of those food plants ship nationwide. There’s no additional stop for inspection when they get to their destination. We have to rely on whatever inspection they did at their home location. God save us if they did a shoddy job.

As if Uscis carters to illegal immigration. Why post those kinds of messages on the website instead of the border where the illegal immigration is happening?

Basically if you are here seeking asylum and you go to Uscis to legalize your stay, you might feel targeted by such subtle threats. They forget people have to actually be here first before applying for asylum.
