Hello All,
Received an RFE and unsure where to start. Applying for EB2, Background law with over 15years experience in regulatory compliance and anti money laundering. I have an award, professional memberships, publications and reference letters. I incorporated a Company in USA for credibility. Also did a patent and have a sound business case. Got potential investment letters for AML business idea. Used an agent who has prepared a response to the FRE, but need a 2nd eye. Anyone that can help would be greatly appreciated.

Who knows the average timeline for EB1 DQ to IL, or which DQ month has gotten IL recently for EB1?

The US Consulate in Lagos is currently handling interviews of DQed applicants (all employment based categories) in March 2023. So, you still need a lot of patience.

The IV scheduling tool shows that Lagos is in March 2023 for EB1. If I were you, I would transfer my case to another country instead of wasting all that time waiting. Use the IV tool and find countries that are current. I think I saw Benin was in July 2025 as well as Cameroon and a few other countries for EB1.

The EB-1A Visa has the most stringent requirements among all green card categories, making it difficult for many applicants to qualify. For example, you must be in the top percentile in different fields to qualify.

The EB-2 visa requirements are relatively lower than the EB-1, making it a more accessible option for more applicants. The EB-1 is reserved for individuals with the highest recognition and achievements in their fields.

It doesn't matter. The way you present your case matters. If you present your case convincingly well then you are good to go. Did for someone with 3 peer review and 3 publications and it got approved. Is all about PRESENTATION.

This visa category is all about making your case if you have the basics checked. Na you go still tell them say, based on this and that, I belong in the top percentile of individuals in this field. If you meet at least three of the 10 criteria and have the evidence to support your case, don't let that top percentile thing discourage you. About 70% of applications in this category get approved as compared to over 80% for EB2, yet for some individuals, making a case for EB1 is easier than for EB2. I honestly believe that if someone meets those criteria, making a case for EB1 is much easier than making it for EB2.

Please, I need your advice to assess my EB1/EB2 visa preparation. I have a BSc in Nigeria and an MSc in the UK, both in a business-related field. Worked as a teacher for 7 years and then switched to Digital Marketing/ IT Project Management roles since 2021 to date.

I have co-authored two peer-reviewed papers that were recently approved for publication and one speaking engagement at an international conference. I may have one more paper published and possibly another speaking engagement before the end of the year. I plan to apply for either EB1 or EB2 NIW from the UK by November/December.

1. With this profile, do I stand a chance?

2. If no, what would you recommend to boost my chances between now and November

3. Would you advise I pursue EB1 or EB2?

4. From experience, what's the average total cost I should prepare for?

5. Any other additional advice would be appreciated

I recently transferred my case from Lagos to Frankfurt and I’m currently waiting for my Interview Letter (IL). However, for the past 14 months, I’ve been unable to secure a family reunion visa for my wife and children.

I also tried to explore getting a Schengen visa for them through another country, but I was told they would only get a maximum of 10 days. That’s not enough time to complete medicals and the rest of the process.

Should I get IL from Frankfurt, I will be faced with the me in Frankfurt and my family in Nigeria- how do I navigate this?

Please, I’m asking for advice. If anyone here is in a similar situation; living outside Nigeria (excluding the USA); and you successfully navigated this with your dependents back in Nigeria, I would really appreciate it if you could share your experience. Feel free to DM me or share it here, whichever is more convenient.

I don't know of your case but I noticed that the RFE that I received for a friend was already included in the original petition.
I stated that the RFE was issued in error because the requested evidence was already included.
Re-summited the exact same documents, but this time highlight the relevant sections
I clearly pointed out exactly where the requested information can be found in the original filing.

If you have filled in 22/23 you would have been approved in a flash but the approval rate now is alarming. They don't read the petitions thoroughly. Present govt policy is also a factor.

I had no idea that German family reunion visa is difficult for immediate family members. Do you have an ETA for your IL? You have the option of attending the interview alone, receive your immigrant visa and file I-824. Your dependents can complete their process in Lagos.
Did you confirm the maximum stay for the Schengen visa? You may want to confirm that to make sure you have the accurate information.

You shouldn't have resubmitted that exact documents. You should have augmented the RFE sent to you. Those guys are thorough. They hardly make mistakes. You might eventually be given NOID later on..

Things have changed. Most people don't know the kind of pressure these guys face. The workload is much. A friend had to resign because of the workload. Then some layoffs for an understaffed institution. If you had the opportunity to read the RFE and the original petition, you'll understand better. I've seen/heard more mistakes this year than ever. The educational requirements for those working in that unit is high but the burnout is real.
98 % approval rate to 40% is not as a result of less qualified candidates. There are a lot of dynamics at play.
