🚨Did You Know?🚨
Under Nigerian law, if your legally married wife denies you sex — not just once, but repeatedly — you can actually take her to court and get a court order for her to give you your right! 😳
Yes o! The court can issue what is called an “Order for Restitution of Conjugal Rights”. This simply means that the judge will order her to return to the marriage bed and perform her marriage duties! 😮
📚 This is not vibes or cruise — it is real law! You can find it under the Matrimonial Causes Act of Nigeria.
Before you rush to file case, please, note:
⚖️ This applies to legal marriages only (not just boyfriend/girlfriend or "come and stay"wink.
⚖️ The court will first try reconciliation.
⚖️ It also works both ways — wives can file too!
What do you think? Should the court be involved in bedroom matters? 🤔

This one no follow at all. Where the statement is in red in the law. A return to cohabitation in the case that a spouse has moved out of the matrimonial home, which is what an Order for restitution of conjugal rights is, is not necessarily a return to the marriage bed or performance of what you tag marriage duties. The courts have no right or authority to overturn an individual's right to bodily autonomy. I would very much like to understand how you came about this connection you have made here. undecided

I can just about imagine some judge in a court ordering me to lie there and get fuqed.

In fact, brave is the person who fuqs on a judge's order. Such can't value their life and existence much.

Here's some history on the matter.

It sounded familiiar.

Opiti99:
A housewife, Saratu Haruna, on Monday dragged her husband, Isa Mainika before a Kaduna Sharia Court two, Magajin Gari for allegedly denying her sex for 10 years.

you should google section 47 of the Matrimonial Causes Act. it provides for the restoration of conjugal rights.

no it is under the law both the south and north as long as it is a statutory marriage. you should google section 47 of the Matrimonial Causes Act. it provides for the restoration of conjugal rights.

Where is the law written? What you stated is likely not the law but a misrepresentation of the law. undecided

The following is the content of section 47 of the Matrimonial Causes Act.
47. Ground for decree of restitution of conjugal rights
A petition under this Act by a party to a marriage for a decree of restitution of conjugal rights may be based on the ground that the parties to the marriage, whether or not they have at any time cohabited, are not cohabiting and that, without just cause or excuse, the party against whom the decree is sought refuses to cohabit with, and render conjugal rights to, the petitioner.
It does not state that the courts can force a spouse into having sex with another. Clearly, the above merely states grounds on which the petitioner can sue. It does not suggest the judge can force an individual to have sex in the marriage. undecided

All the man simply needed to do in that case was file for formal dissolution of the marriage. Case closed. No judge can force anyone to have sex with another, regardless of marital status. undecided

Bodily autonomy allows even a woman you are married to to deny you sex whenever she wishes; the man has the same right in marriage. undecided

2. Better marry a prostitute or a gigolo then whose timetable you can control by way of fees paid then. undecided

3. Even your so-called sidegal has the same rights to bodily autonomy. undecided

It does no such which you claim. All it states is that a petitioner is allowed to sue under those circumstances. undecided

when the law recognizes a right and obligation and permits a person to sue to enforce it what else do you need to make it enforceable. if the court order to restore conjugal right is obtained it is a ground to divorce without any other excuse. That is also a way of enforcing it.

I can deny you sex because you are inconsiderate, insensitive, I'm not in the mood, my hormones are playing up, I don't like the fact you screwing someone else and might give me a disease, and so on.

If only we made love instead of you having sex, I'd likely be begging you to.

I doubt if there is any law that can force a person to have sex whether married legally or not!

The most you can do is to use it as grounds to get a divorce or dissolution of the marriage contract!

Married individuals have no rights that supercede the individual's right to bodily autonomy; no such obligation as that assumed by you exists for those who are married. undecided

2. A right to sue is just that, a right to sue. Nothing more. What the courts can do in response to a suit is some entirely different. undecided

3. The court is limited in what it can or cannot do. No court has right to force two individuals to have sex. It cannot override an individual's right to bodily autonomy. And as you pointed out there, a suit of this kind creates good ground for divorce by the other couple. undecided

there is no law without exceptions. Bodily autonomy cannot override marriage obligations same way the fundamental rights of a child cannot prevent a father from punishing him for purpose of discipline. If you deny your husband his marriage obligations he has the right to go to court to get a court order to make you give him his marriage rights.

This, again, is where you have it wrong!

Bodily autonomy is a fundamental human right which cannot be overridden by your courts. undecided

2. A father choosing to assault/violate the rights of a child while the law turns a blind eye in your country DOES NOT imply an exception to the law. Rather, what you describe is instead the result of corruption in the system. undecided

3..The court has no right to require an individual have sex with another individual, not even if they are both married. judges are not gods and they do not decide the law.... Rather, they aid in the enforcement of existing laws. These laws are meant for human; not imposed by gods on humans. undecided
