Hello everyone,

I received an Interview Letter (IL) in Germany, but my family is still in Nigeria. I had earlier applied for a family reunion visa and have been waiting for an appointment for 15 months. Hoping my employer could help, I transferred my case from Lagos to Germany. Now I have IL for myself but no visa appointment for my family.

I have tried every possible option:
• Requested embassy-to-embassy transfers to visa-free countries in Africa. Some ignored my request, others declined.
• Contacted the U.S. Embassy in Germany where I got IL. They said:
• They cannot advise me.
• If I want a transfer, I must first get approval from another embassy, and only then will Germany release the case.

I do not want to return my case to Lagos due to the unpredictable backlog. At this point, I see only two options:
1. Transfer back to Lagos (which I strongly want to avoid), or
2. Reschedule — but to when? Since I have no idea when the German Embassy in Nigeria will grant my family an appointment.

Getting a Schengen visa has also failed. Right now, I am running out of options and really need advice or assistance.

Can’t you attend the interview in Germany alone then change your family to Follow to join and they attend in Nigeria?

Alert the embassy your family will migrate at another time. Your family will however take sometime to get interview in Lagos. That’s the only feasible choice.

Do I qualify for EB1 or EB2?

More info is needed but you are eligible for EB-1. Applying for EB-2NIW will be embarrassing to your CV.

This is not true. I can see you've been advising a lot of people to blindly file EB1 and this kind of sub-optimal profiles are been rejected (or RFE) daily. The best approach is to file EB2 first to lock the priority date.

There is no database to search this. You have to understand the US and the world to argue how important is your endeavor to the United States.

I will say Marine Security is of national importance to the US. You have to tailor your arguments towards 1. Security of the US sea port of entry and water ways such as adequate security of these prevent the US from external threats that can come through them. External threat could be terrorists, human and sex trafficking, etc. 2. Commerce. The sea ports are of very economic and commercial importance to the US. Safety and security lapses at these ports can have serious devastating effect on the economy of the country. 3. The sea and the oceans surrounding the US are also of national security against foreign adversaries like Russia, China etc. The US Coast Guard, Marine and Navy can use your expertise.

These are the ones I can think for now. There are many ways you can argue how Marine security is of national importance to any country.

Having said that, you must research data, articles, publications to back up all your claims of how Marine security is important to the US.

I want to make my company transfer me to the Ivory Coast branch of our office, so that I can go there, process a legitimate work residence permit and then a legit employment certificate for applying for a visa in Ivory Coast German embassy.

You’ve really tried. Have you tried applying for Schengen visa for them? Maybe through one of those countries that aren’t over flogged?

You already meet the basic requirement for EB-2 because you hold a Master’s degree. But for the National Interest Waiver (NIW) part, USCIS looks beyond the degree they want proof that your work has national importance and that you are well positioned in your field (for example, through publications, awards, certifications, conference talks, or recognized contributions). Since you are just starting out in cybersecurity, you don’t yet have enough evidence of that broader impact, so your case for EB-2 NIW would be considered weak right now. This is just my opinion.
You’re definitely not an EB1 candidate just yet.
What about someone with high school certificates (WAEC or NECO), can they qualify for EB-1A?

To qualify, you must show sustained national or international acclaim and that your achievements have been recognized in your field. You also need to show that you intend to continue working in your area of expertise in the U.S.

There are two paths to eligibility:

1. One-Time Achievement
• Receipt of a major, internationally recognized award (e.g., Nobel Prize, Academy Award, Olympic Medal).
If you meet this, you don’t need to show other criteria.

2. At Least 3 of the 10 Regulatory Criteria

If you don’t have a major award, you must provide evidence of at least 3 of the following 10 criteria:
1. Receipt of lesser nationally or internationally recognized prizes or awards for excellence.
2. Membership in associations in the field which require outstanding achievement of their members.
3. Published material about you in professional or major trade publications or major media.
4. Participation as a judge (individually or on a panel) of the work of others in the same or related field.
5. Original contributions of major significance in your field.
6. Authorship of scholarly articles in professional or major trade publications or other major media.
7. Artistic exhibitions or showcases (for artists).
8. Leading or critical role for distinguished organizations or establishments.
9. High salary or other significantly high remuneration compared to others in the field.

When his date becomes current, he will file for AOS (Form I-485) in the US. He will need to file form I-824 (Follow to join) at the same time for US Consulate in Lagos to be informed. He should file both forms together with USCIS. Once the I-485 is approved, USCIS will also approve the form I-824 (sometimes at the same time as the approval of form I-485, sometimes at a later date. On the approval of the form I-824, USCIS will inform NVC who will then send the Welcome Letter to you.

So far, I've written four (4) reference letters (recommendation letters)
I'm working on my letter and expect to finish it by this time next week (31/03/2023).)

I will equally send to two of my friends to help double-check. (so as to implement their feeback)
Finally, I will submit everything to my personal lawyer to double-check before sending to USCIS in April.
Hopefully, I'll be in the United States by January 1, 2024.
