YOU DON'T HAVE SUCH POWERS TO SUSPEND LG CHAIRMEN, AGF FAGBEMI TELLS EDO GOV OKPEBHOLO

Attorney General of the Federation and Minister of Justice, Lateef Fagbemi, SAN, has told the Edo State Governor, Monday Okpehbholo that he does not have such constitutional powers to suspend local government Chairmen.

The Edo State Governor had issued an order to the Edo State House of Assembly and demanded of them to suspend the chairmen.

Acting on that order, the Assembly suspended the 18 local government chairmen and their vice chairmen on December 17, 2024.

Governor Okpebholo had accused the chairmen and their deputies of insubordination.

He also alleged misconduct on the ground that they did not submit their statement of finances to him.

But AGF, Fagbemi, SAN, had faulted the action when he answered to questions from newsmen at a public function in his office on Thursday.

AGF Fagbemi, SAN, said that it was only the legislative arm of local governments that can sack or place council chairmen on suspension.

He stated that under the current dispensation, local government chairmen cannot just be removed or suspended by any governor without following due process of law.

“I am aware that since July 11 when the Supreme Court delivered a landmark judgment, local government administration has taken a new turn, different from the old order.

“At any rate, we are still studying the situation but before final reaction, it must be stated categorically and emphatically that for now, local government chairmen can only be removed through the legislative arm of the local government itself and not the State House of Assembly."

was the insurgency in Rivers more than, Benue, Plateau, Zamfara, Borno< Katsina, Niger and so on? why hasn't he declared SOE in those places?

So your president can be partial but his governors should not be abi?

What good example is he teaching them?

In that case, I expect the Minister of Finance to stop allocation to the Local governments in Edo State just like what is happening in Osun State. If Tinubu cannot do this, then he's playing double standards which is not good for our democracy.

But the man is running around struggling to convince Nigerians that Tinubu has got the powers to remove Cuba.

This country ehn. The Governor has no power to suspend local government chairman but the president has power to suspend a governor and Senate president or bunch of senators has power to suspend a senator.

That's very correct. Governors don't have power to remove elected LG chairmen.

It's all about doublestandard because they stop paying Osun State Local Government allocation but yet Edo State receives theirs because it's an APC State. It's not enough for AGF to say it actions must be taken.

Rivers state governor's suspension was right to the AGF but Edo state suspension of LG chairman wasn't right to him?
The act by the PRESIDENCY to suspend a sitting governor under the coyed and guise of economic decision is palatable but democratically barbaric.

The AGF has told him in unequivocal terms that he lacks the constitutional powers to suspend or sack LG Chairmen.

Edolites must warn him to desist from arrogating to himself the powers that doesn't belong to him.


But, come to think of it, Okpebholo is following in the footsteps of Mr President who sent a state Governor on a six months forced "honeymoon".
