Even when you have not paid your rent for years, your landlord does not have any right to shout on you, threaten you or throw away your property. The only option he has is to serve you a quit notice and other necessary statutory notices provided under the law and then take you to court where he will ask the court to allow him to recover possession of the property. Anything he does on his own to kick you out of the house is called self-help. If he shouts on you, threatens you, locks you out or cut off your electricity or water supply that is called self-help and it is illegal. It can even lead the landlord to prison because the law is against any form of self-help. You can even sue him for that and get a lot of money from him. Where the law provides for a way to do something anything else done becomes illegal and can attract serious liability. The law is very clear on what a landlord should do when his tenant has not paid him rent and if he decides to exercise self-help, he will not have any excuse under the law. In the eyes of the law, the tenancy contract is effective until there is a valid notice to quit. Even after the notice to quit has been served the other relevant statutory notices provided by the law must be served at the right time before the landlord can even go to court. There is no need to panic when your landlord serves you a quit notice because it does not mean a QUICK NOTICE(most Nigerians call it QUICK NOTICE). It does not mean that you must QUICKLY PACK out of the house, it does not mean that he will QUICKLY THROW you out of the house. It does not give him any right to abuse, threaten you or make you uncomfortable. It is not the end of the process for sending you out of the apartment. Infact it is just the begining part of the journey so do not panic. It simply means that the landlord wants to quit from the tenancy contract. It is like telling your girlfriend that you want to quit the relationship. |

I don't know where you studied your own law but what I know is that when a tenant repeatedly defaults on rent it can be taken as a vitiating element which automatically terminates the tenancy agreement. Stop giving false hope to habitual rent defaulters! |

For example, if it is not specified in the lease document that defaulting on rent serves as a mitigating reason for termination, it becomes hard for a landlord to prove in court that it should be considered so. ![]() These clauses are typically not assumed but clearly specified for them to take effect. So, yes, OP is sort of right that your landlord has no right to destroy your property unless you, the tenant, specifically agree to such treatment should you default on your rent. ![]() |

The laws are easier to abide where supply outweighs demand. In Lagos, it's a demand over supply issue and one mistake, you're homeless and can't afford to rent a new place due to the extra costs. |
