The Kanu case exposed something deeper , just how many Nigerians are ignorant of the law. Too many people argue emotionally, not legally. The most ignorant batch are the ones parroting his “where is the written law?” I ask again , does it mean the average Nigerian doesn’t know what the law says, or is Google not available on certain phones? The law that governs you depends on where you are and the jurisdiction you’re under. If you’re in America, American law applies. Break the law here, and you’ll face the consequences under U.S. law. But if you commit a crime against Nigeria, you will be tried under Nigerian law. There’s no escaping it. What many Nigerians fail to understand is that laws are not universal. The U.S. Bill of Rights, freedom of speech, or due process do not automatically apply in Nigeria. Nigerian law governs the Nigerian state. Offenses against the Nigerian government or society are prosecuted under Nigerian statutes, in Nigerian courts, and punished under Nigerian penalties. And for those asking “where is the written law?”, here it is: Under Section 4 of the Nigerian Criminal Code Act, any person who does an act partly in Nigeria and partly elsewhere that constitutes an offense in Nigeria can be tried in Nigeria. Further reinforced by Section 12(1) of the same Act , if the effects of an offense occur in Nigeria, the Nigerian courts have jurisdiction. And Section 3 of the Terrorism (Prevention and Prohibition) Act (2022) gives Nigeria jurisdiction over terrorism or related offenses committed outside the country if they are directed at or affect Nigeria, her citizens, or her interests. Now, to correct another ignorant talking point , the law was never repealed. The Terrorism (Prevention and Prohibition) Act of 2022 did not abolish or nullify earlier laws; it replaced and strengthened them. A repeal means the law is removed without replacement. In this case, it was updated and consolidated, meaning all prior offenses committed under the old law remain prosecutable under the new one. Several terrorists, kidnappers, and bandits have already been tried and sentenced under this same Act. It’s not new, and it’s not selective. The statutes are clear and actively enforced. There was a reason , the judge asked him to get legal counsel, he was advised severally to open his defense, and also asked him to read his charges. He refused. Shouting is not defense. It will gas your followers up but it will not do chakam to negate or nullify the law!! Any lawyer worth his billable hours would have told him that. But Eze Onyeagwalam and his followers think he is above the law. And for those still shouting “Biafra,” here’s a hard fact. Biafra doesn’t exist. So whether or not you know the law, like the law, or agree with the law is completely immaterial. You are still bound by Nigerian law. Because that is the only law that exists and governs the territory you live in. This is why conflating “Western” legal principles with Nigerian law is dangerous. Ignorance of the law is not an excuse. If you act against the Nigerian state , whether through speech, actions, or financial dealings , you are under Nigerian jurisdiction and will be held accountable accordingly. The crime he committed was against Nigeria. The victims of those crimes are Nigerians in the South East of Nigeria! Nigerians, especially those who live or have lived abroad, must understand this distinction. Where you commit a crime matters, and so does the law of that land. He may only be found guilty of: 1. inciting violence and killings through broadcasts allegedly transmitted across the country. 2. illegally importing a radio transmitter. While he will be aquited of d other charges including terrorism. I believe he would have gotten a level of defence if he had entered defence and he would have brought up all these points he's making now. He made it look like he was only charged of only terrorism. |
