Is it possible for NDLEA officers to just finger out a sign board (someone who smokes hemp and it's obvious by lips, eyes and foot), then go ahead to carry out a drug test to have proof without the person actually possessing the substance at the time?

If a person can be arrested by the police for driving while drug I see no reason why you cannot be arrested if you are under the influence of narcotics and exhibiting disruptive behaviour

His question is, they see your lips, or eye balls and that raised their suspicions and they carried out a drug test which returned positive even when you weren't in possession of any drugs as at of when they carried their test, can they arrest you base on the drug test result?

Well,if that's clause is added in our national drug act,then one can be persecuted for testing positive for a banned substance.

Testing positive is already an evidence of possession. He possesses the drug in his system ..

Can I be Lawfully Convicted because a ban substance shows up in your blood stream...

What you have in your blood stream could have come from Nutritional Supplements and even certain kind of food that you may have eaten...

If they arrest you unlawfully, get a good lawyer to prove your case that you are not a drug user

and they would be made to pay fine.

The answer is simply yes. Why do they need to test you if they have right to act on the outcome of the result? Not having right to arrest you if you test positive is as good as not having right to test you in the first place.
