If Tinubu wanted to pardon her, now is the time not when it is still under appeal. Now the final Court in the land has spoken, the case has gotten to its final end, he can now do whatever he deems fit.

Her lawyer cited the pardon as a reason the case should be thrown out and it's a NO. Prerogative of mercy comes when the case has expired. Why do you think she hadn't been hanged before now, that is because it is still a live issue.

The President no matter how powerful cannot usurp the Powers of the Court.
They think judicial processes are a function of emotions, leave them.

Read the judgement again, this time slowly.
The court is not denying the executive power but that the President can not put pardon on a running case. The case is still up for hearing in the supreme court, after they have given their verdict, then the President can apply the pardon

Sorry, I don't think the Supreme Court has power to upturn a pardon granted anyone by either the President or a State Governor.
Meanwhile, this is not to say I'm in support of the "pardon"....or already withdrawn earlier granted to the husband killer.

Go and read the judgement. The lead judge said it is improper for the Executive to exercise any prerogative power since the case is still pending before the supreme court.

Whenever a case is still active before any court, it is prejudicial to take any step or action not prescribed by the court.

Unfortunately, you are correct. A presidential pardon overrides the authority of the court to convict. Once pardoned, you are as clean as a slate. Anything the courts do now regarding this matter is purely academic. That's why presidential pardons should only be used for political prisoners or convicts who obviously were convicted wrongly.

I think this issue has be settled since and the pardon by default was withdrawn so what is your noise about now.

Well clearly the issue is that the government should have waited before issuing the pardon, not that they can overrule a pardon that follows all laid down rules.

And obviously this was not the case or the issue in front of the Supreme court, so this looks more like a reminder than a judgement. Also if it was a judgement on the matter, it would be final and irrevocable, and obviously it is not, as the President can reinstate it now.

Just another own goal by his staff and advisers, if the AGF was involved in this it is really really sad and it seems incompetence is everywhere in the country.

According to the constitution, the pardon can be nullified if it failed in following proper procedure or if the case is still before the courts. Her case was still under appeal, so according to the constitution, the pardon can be set aside as it is considered an executive overreach.

You are very correct but the pardon must come only after judicial processes have ended.
It's very irresponsible for Tinubu to pardon somebody for a case that is still under litigation.
Now let me ask you, what if the appeal was successful and she was found not guilty of the crime and released by the Supreme court, won't the pardon be useless?
Tinubu through the AGF was supposed to refuse to pardon anybody whose case is under appeal to avoid all this.
If you want a pardon, don't appeal your sentence, appeal for a pardon instead.
You cant be appealing a sentence and at the same time requesting for a pardon, it means you are not remorseful and makes a mockery of both the presidential pardon and the judicial system.

The appeal for pardon came from the lady’s family and more importantly the late husband’s father because of of the children. Though it might have a political undertone.
