Appeal Court Jails Senator Peter Nwaoboshi For 7 Years For Money Laundering

The Supreme Court has upturned the conviction of Senator Peter Nwaoboshi and his sentencing to seven years imprisonment for offences of fraud and money laundering.

The apex court ordered his immediate release from Ikoyi prisons in Lagos, where he is currently being held.

In a lead judgment by Justice Emmanuel Agim, the apex court held that Nwaobishi and the two companies were unjustly and maliciously prosecuted by the EFCC for committing no offences known to law, and subjected them to criminal trial in relation civil transaction, needlessly.

The Supreme Court has upturned the conviction of Senator Peter Nwaoboshi and his sentencing to seven years imprisonment for offences of fraud and money laundering.

The apex court ordered the immediate release of Nwaoboshi, who represented Delta North in the ninth Senate, from Ikoyi prisons in Lagos, where he is currently being held.

Delivering Judgement, the court also freed the two companies – Golden Touch Construction Project Ltd and Suiming Electrical Ltd – tried with him on a two-count charge brought against them by the Economic and Financial Crimes Commission (EFCC).

In a split decision of four-to-one, the Supreme Court set aside the July 1, 2022 judgment of the Court of Appeal, Lagos, which had reversed their discharge and acquittal by a Federal High Court in Lagos.

In a lead judgment by Justice Emmanuel Agim, the apex court held that Nwaobishi and the two companies were unjustly and maliciously prosecuted by the EFCC for committing no offences known to the law, and subjected them to a criminal trial in relation to a civil transaction, needlessly.

The EFCC had accused Nwaoboshi and his companies of illegally acquiring a property named Guinea House on Marine Road, in Apapa, Lagos, for N805 million, the property said to belong to the Delta State Govt.

They had claimed that part of the money paid for the property was transferred by Suiming Electrical Ltd on behalf of Nwaoboshi and Golden Touch Construction Project Ltd, adding the funds are believed to be proceeds of their illicit activities.

EFCC under Bawa was the most clueless since it inception.
When Ribadu left EFCC, that was when the commission became children playground.

Those guys in EFCC are nothing but fraudsters, thieves and dubious fellows. They always ho for the highest bidder in their dealings and that's why Nigeria will continue to have divided judgement cos lower court judges are corrupt as well.

He was prevented from running for Senate... Election is over there is no point keeping him there again

Nigeria judiciary is a problem

There should be a law that if 5 of your case get overturned by a higher court in 10 years you would be removed as a judge

Enough of high court judges doing politician's bidding without consequences

They issues judgement they know can't stand review... Because what's the worse that can happen?

Everyday the Courts relentlessly oppose the executive but some persons will still carry about this narrative that the Courts are not independent or that Nigerian judiciary is a mere tool of the executive.

I always ask such persons to mention the cases they know of, and explain how the judgment was faulty. They never can.

Think about this: as fantastically corrupt as Nigeria is with crooked politicians,not one politician has gotten true justice. They almost always gets away with WHATEVER. I don't believe there's anything like a justice system in Nigeria

Even the Yahoo how many them done convict without the suspect pleading guilty?

Most of their evidence are gotten by intimidating the suspect which renders their case useless

Just that most suspect don't want to spend a day or two in prisons because of the conditions of our prisons
