The court ultimately denied the emergency petition for a "writ of mandamus" because the government failed to prove it had "no other adequate means" of obtaining the relief.

The judgment suggests that the DOJ should follow standard procedure—either by resubmitting an improved affidavit to a different judge or by seeking a grand jury indictment—rather than asking an appeals court to intervene in an "unprecedented" emergency fashion.

Chief Judge Patrick Schiltz argued that despite the DOJ's national security concerns about "copycat raiders," there was "absolutely no emergency" that justified bypassing standard judicial review.

For the Trump administration, this is a major moral victory. The Eighth Circuit has confirmed that the evidence against Don Lemon did meet the legal standard for arrest from day one.
