Afroman wins legal battle over songs mocking US police

US rapper Afroman has defeated seven sheriff's deputies in a court case after they sued him for releasing songs and videos that mocked them and a raid they carried out on his home.

The officers broke down the musician's door in 2022 as part of a drug and kidnapping investigation, but the raid didn't lead to any charges.

Afroman, best known for his 2000 hit Because I Got High, responded by using home security footage in viral videos that ridiculed the deputies. His video for the song Lemon Pound Cake was inspired by a deputy apparently eyeing a cake in his kitchen, while another video attributed personal and sexual transgressions to the officers.

They sued him for defamation, but a jury has sided with the colourful rapper after a three-day trial.

"We did it America! Yeah! We did it! Freedom of speech!" Afroman yelled outside the Ohio court, surrounded by supporters, in a clip posted on social media after the verdict.

Real name Joseph Foreman, the musician gave evidence wearing a red, white and blue US flag-themed suit.

"The whole raid was a mistake," he told the court. "All of this is their fault.

"If they hadn't have wrongly raided my house, there would be no lawsuit. I would not know their names. They wouldn't be on my home surveillance system, and there would be no songs, nothing."


'Attempt to silence criticism'

The deputies requested $3.9m (£2.9m) damages for "humiliation, ridicule, mental distress, embarrassment and loss of reputation".

Afroman released songs including one that featured graphic and unfounded suggestions about Deputy Lisa Phillips' sexuality.

Sgt Randy Walters said his child had been humiliated at school over Afroman's posts, and had come home afterwards in tears.

The deputies' lawyer Robert Klingler told the court the rapper had "perpetuated lies intentionally" about his clients.

"Even if somebody does something to you that hurts you, that you think is wrong - like a search warrant execution that you think is unfair - that doesn't justify telling intentional lies designed to hurt people," he said.

Afroman released an entire album in 2023 about the incident, calling it Lemon Pound Cake, while its title song also took aim at the officer who, the lyrics said, "got the munchies because he got high".

That song has had 3.6 million views on YouTube, while another parody track titled Will You Help Me Repair My Door has had more than nine million.

The rapper told jurors he had a constitutional right to make artistic and critical content about government officials.

His lawyer David Osborne argued that public officials could not use the courts to "silence" criticism simply because it hurt their feelings.

"I'm sorry they feel the way they do, but there's a certain amount that you have to take as a public official, it's part of the duties of the job," Osborne said.

"What chilling effect does that have on the world we live in? You don't like what a public official does and you make a joke, and you're dragged into court?"

You might remember Afroman (real name Joseph Edgar Foreman). He's the rapper/singer who released the song Because I Got High in the year 2000.

Basically in the song he says that he was supposed to do all kinds of things (go to work, clean his house, etc), but he didn't because he got high and then he sings about the consequences. It's a very funny song.

What's happening now

In 2022 some policemen broke down Afroman's door and invaded his house on suspicion of kidnapping and drug traficking. Afroman said that they scared his children. No arrests were made and no charges were filed.

Afroman reviewed his CCTV footage of the raid and noticed several things. One of the policemen that was searching his kitchen saw a pound cake on the table, did a doubletake and looked longingly at it.

Afroman also accused the police officers of stealing four hundred dollars from his house.

The policemen damaged several things in Afroman's house (obviously including his door), but they refused to pay for them. So Afroman did the brilliant thing and released an album about the raid in order to pay for the damages. 🤣 These were what the songs were about.

1) One song is called Lemon Pound Cake and in it he makes fun of the size (fat) of the policeman that looked longingly at the poundcake.

2) In another song he makes fun of a female police officer's weight. In the video of the song she is chasing him, but she's too fat and can't catch him. He also makes claims about her gender and sexuality.

He used the real CCTV footage of the raid in the music videos. The songs went viral and did huge numbers on social media.

The police officers sued him for defamation of character and violation of privacy (because he used CCTV footage of them in the music video).

Remember what I said about defamation? It's your reputation that is on trial. The police officers had to endure difficult questions, all the music videos were played in court, etc. The police officers ended up crying in court. One of the police officers said that people were sending pound cakes to their station.

Meanwhile Afroman was a pro, he frustrated the police officers' lawyers.

Well, Afroman won in court (the court ruled that he was within his free speech rights and that the police officers put themselves in the view of his CCTV cameras) and he has made another song about the trial.

Afroman says it's the police's fault. If they hadn't broken into his house, then his money would have been complete, his house would not have been damaged and he won't have made the songs.

and l also find his song "One hit wonder", very amusing and intelligent at the same time. the way he crafted it and responded to the insinuation of being a One-hit wonder, was so refreshing.
Is it a trend, that White Police are always trying to destroy Black Men, especially the Rich and famous Black Men, Artistes, Sportsmen, etc, in the western World?

But l am just thinking, Police are the same thing, all over the world: Sense of entitlement and being above the law, abusing their privileges and disrespecting the citizens.
Now, what could have happened, if this incident happened in Nigeria?
With they rob all his Trainers and that Music Box, his Jewelries and other stuffs, during the raid?
Will they come back and raid his Home again or even shoot him in the process, after he made the Music taking a swipe at their initial behavior?
Would they plant Drugs in his Home and then arrest him for it, as they do, during stop & search, at the various Road Blocks?

And after all said and done, can he ever get Justice in our Law Courts, with the kind of Judges we have in Nigeria at the moment?

I see it more like an institutionally planned system over there, I might be wrong though but that's what it looks like to me, I see it more as stopping or destroying generational wealth transfer, for instance:

An African American at a young age becomes famous and rich and he is living his life probably copying what some other whites in his industry are doing, believing he is above the system or will always get the same privilege like his white counterparts, only for the system to wait till they get to a certain age and start fighting them"

In most cases, either their wealth is scattered, they are locked up in jail, their properties are seized, accounts are frozen and so on, or they are asked to pay fines or taxes that may end up wrecking them.

In all they wealth was only enjoyed by the person and probably his immediate family, you find out most of the wealth is either not transferred or fully transferred to the next generation of the person, what was probably supposed to become an empire over time from generation to generation is scattered.

A lot of the big names in various industries you see today in the U.S are from past generations, from movies to music, hospitality, food, grocery stores and so on belonging to the whites.

It is looking more like a coordinated pattern, and somehow I feel the African Americans there are not yet seeing that pattern to be more carefully and start teaching the younger generation of theirs to take it very serious in the kind of life they live there.

I find out most of them just live this carefree life and that's what they keep using against them.

Take a look at most industries there, the people who still control them, a lot are still controlled by the whites even after you have so many big names of African Americans who should have been taking over some of those industries.

I watched Michael Jackson's interview about Sony music and he detailed how he was been cheated for decades with so many things he said, in fact at the time he said they were owing him about a billion dollars or so, he said he was going to expose a whole lot of things, he was planning a big show then( This is It) I don't know of he ever did it, because he died I think not too long after he was making those allegations loud.

Just take a look at all the big names that have come out from the African American community and till date they don't control a lot of the industries there, the richest black man in the world is still from Nigeria in Africa here.

It is like they get rich and famous but end up scattering it and hardly gets transferred either, they need to start getting very conscious and get smarter with handling their affairs.

Only a few have tried to maintain themselves, but that number is quite small compared to the larger number.
