WHO REALLY OWNS YOUR MEDICAL RECORDS IN NIGERIA? GROWING QUESTIONS OVER HEALTH DATA CONTROL

A quiet but important debate is emerging in Nigeria’s healthcare space over a simple question with no clear answer: who actually owns a patient’s medical records?

At the centre of the issue are existing laws such as the National Health Act (2014) and the Nigeria Data Protection Act (2023). While both laws set out rules on confidentiality and data protection, they do not clearly define ownership of medical records, leaving a legal grey area around patient data.

This uncertainty has raised concerns among health and digital policy experts, especially as Nigeria moves toward more digitised healthcare systems.

DATA SYSTEMS AND FOREIGN INVOLVEMENT

Reports indicate that a large portion of Nigeria’s HIV data, covering over 1.4 million patients, is stored within systems supported by international partners, including the U.S. Centers for Disease Control and Prevention.

Health partnerships between Nigeria and foreign agencies have also been linked to data sharing arrangements involving disease surveillance and research activities. However, the extent of national control over some of these datasets remains a subject of public debate.

LOW DIGITAL RECORDS ADOPTION

Despite progress in health tech, electronic medical record adoption in Nigeria remains limited. Estimates suggest that less than 20 percent of health facilities use digital systems for patient records.

As a result, a significant portion of medical data is still recorded on paper, stored locally, or inconsistently managed across facilities. This has made it difficult to create a unified or easily accessible national health database.

HOW HEALTH DATA IS CURRENTLY USED

Medical data collected in Nigeria is used by different actors for various purposes, including:

1. Government health planning and policy development
2. International health programmes and donor-funded projects
3. Pharmaceutical research and clinical studies
4. Health insurance claims processing

However, access and transparency remain uneven, with patients often unaware of how their information is stored or used.

GROWING CONCERNS

Experts warn that the current structure raises concerns around data governance, privacy, and national control. Without clear ownership frameworks and stronger infrastructure, patient data may remain fragmented and vulnerable to misuse or limited oversight.

There are also calls for stronger enforcement of data protection laws, improved digital infrastructure in hospitals, and clearer rules governing international data-sharing agreements.

FINAL NOTE

Health data is more than administrative records. It contains sensitive personal and medical history that can influence treatment, policy, and research.

As Nigeria expands its digital health systems, the central question remains unresolved: not just how secure the data is, but who ultimately controls it.

Medical records in Nigeria ? lol. Very funny . A country where one government hospital will overlook the records of a previous government/private one and vice-Versa while asking you to conduct a fresh medical examination in their place or one of the doctor’s choosing ?

Sabi sabi, The HIV part, make they hold the data and see if they will get intervention, the West have been sustaining the health industry in Africa, most of the drugs we buy here cheap is as a result of subsidy been done by them. Yet our leaders loot the money that comes in through the donors

I love this piece of write up but i feel that topic is somehow.. you see some of the data collected are used by every reasonable countries for proper projections and predictions event that is likely happen in the future. Health Data collection is used in preparation for medical need of every nation. It’s important that the government have data about your health and it also gives them insight when calculating, mortality and fertility ratios of any given country.

The hospital of course. I tried snapping my medical record one day because I wanted to complain to my HMO about the drugs I was given, hospital said my HMO doesn't cover the drugs and gave me an alternative. If you see the speed at which the nurse snatched the record from my hands and even reported me to their medical director. I went to the MD to explain and he was like, their policy doesn't allow patients to go with their information. As how now😡

Naturally na patient get their records but your doctor is given the record to keep in trust for you...first to monitor your health and well-being..offering services that could help you overcome your health challenges....one can't be the one suffering illness and another person will own his or her records

They even allow you see your own. If you see argument between me and them for FMC that year ehn. Just to take a look at what they have been doing o. They say i no fit.

This country is a failed entity. You can't even scrutinize your own medical records I private hospitals , talk more of government-owned hospitals. I'm always like , what the eff is going on this these people!

There's a hospital I know who's EMR network is powered by a foreign establishment and they even boasted that there data is so secure that even if they suffer any data loss internally, the foreign org has a system that guarantees that the data will be restored.

I just shake my head, foreigners are packing your health data for free and you think they are doing you a favor

No, in a structured environment with data protection law, you own your record and the hospital has the right to store, read and write on your record, so they are custodian of the data.

You have the right to request for your record/data. In a develop country there are many policies in place for that including SAR (Subject Access Request).

Some countries even have apps to manage your medical record. (make appointments, record medical activities, etc)

Sometimes they might and can restrict what you can have access to on your record. It is more of like a protection. Imagine someone having access to your most sensitive medical records due to your own carelessness or you got hacked.

I think lack of 24hrs electricity is part of why the country is retrogressing.

Even some countries wey no get natural resources pass potatoes and cows dey develop miles ahead of 9ja.

i don't Understand why i would not be Able to see, snap and keep a snap copy MY OWN FILE and RESULT!!

they just expect to tell me to take the med they give me without Questions...

Some of them Even Refuse to Answer Basic Questions like:
1. what did you observe in the test
2. is it a critical condition?
3. what med is this? and what is this med to do for me?

very wicked people!!

If you see their reaction, Your vision go first blur!

I was once given a wrong medication o. Before I left the hospital, I check the drugs and they don't look familiar so I checked on Google and found it was for ulcer. I only complained of back ache and boom they gave me ulcer drugs. When I complained, they discovered they switched my drugs at the pharmacy with someone else's.
