Following oral arguments in March 2026, the Court’s 6-3 conservative majority appeared highly skeptical of post-Election Day grace periods. Legal analysts expect the conservative majority may rule to strike down these extensions.

The Incident: In February and March 2026, Riverside County Sheriff Chad Bianco (a Republican gubernatorial candidate) deployed deputies to take possession of roughly 1,426 boxes of voted ballots from the November 2025 Proposition 50 special election. Justification: Bianco claimed he was launching a criminal investigation into voter fraud after a self-described "election integrity" watchdog group claimed there was a 45,000-vote discrepancy in the certified results. Local election officials countered that the group entirely misunderstood the data. Pushback: State officials slammed the seizure as a dangerous political stunt based on baseless conspiracy theories. California Attorney General Rob Bonta sued to block the investigation, and the California Supreme Court ordered the sheriff to halt the probe and preserve the ballots while the legal challenges played out.
What Law Did Newsom Sign ?
To permanently block future interventions by law enforcement, Governor Newsom signed Senate Bill 73 into law on May 27, 2026, with an urgency clause that made it take effect immediately.The new law enacts strict rules regarding election security and ballot custody:
_Criminalizes Ballot Seizure: It makes it a felony for anyone, including local police, county sheriffs, or federal agents, to knowingly take packages of voted ballots from the custody of election officials.
_Severe Penalties: Violators can face up to three years in state prison, a $1,000 criminal fine, and civil penalties reaching up to $50,000.
_Restricts Law Enforcement Access: Police officers and federal agents are banned from disrupting election workers or accessing voting technology, voter rolls, or ballots unless they have a specific, vetted court order or are responding to an immediate, urgent public safety emergency.
_Protects Voting Equipment: It explicitly prohibits local registrars from voluntarily surrendering voting machines or digital election logs to unauthorized law enforcement requests.

Upon signing the bill, Newsom stated that the law creates clear "rules of engagement" to ensure California's democratic processes are not commandeered by political intimidation or abuse of law enforcement powers.
