As an international law and conflict-resolution practitioner, I am here in Helsinki following the proceedings involving Simon Ekpa in Finland with serious concern.

My purpose is to expose the hypocrisy of Nigeria and Finland to the international scene. To show that from 2016 there was violence in South East of Nigeria

But the fight against terrorism must never become a licence to weaken due process, freedom of expression, or the rights of an accused person.

Finland has its own terrorism legislation, and Finnish authorities should not HAVE USED NIGERIA FAKE EVIDENCE BUT Finnish criminal law.

The difficult legal question is whether the particular conduct attributed to an individual satisfies every constituent element of the specific offence charged, and whether the proceedings fully respect the protections guaranteed by the Finnish Constitution and the European Convention on Human Rights. (Counter Terror Law⁠)

What particularly concerns me is the reported level of cooperation between Finnish authorities and Nigerian authorities in this case. Nigerian officials publicly celebrated the Finnish conviction and described cooperation with Finnish authorities as an important victory. (FAKE EVIDENCE )

That cooperation itself is not unlawful. International cooperation against terrorism is legitimate. But cooperation must not become predetermined justice.

If evidence originating from Nigeria was placed before a Finnish court, the defence must have a meaningful opportunity to challenge its reliability, provenance,authenticity and admissibility.

The court must independently assess that evidence rather than simply accepting the narrative of a foreign government. This is where the rule of law becomes extremely important.I am therefore putting several questions on the record:

1. What precisely were the constituent elements of each Finnish terrorism offence?

2. Was every element proved beyond the required standard?

3. What evidence originated from Nigeria, and how was that evidence independently verified?

4. Was the defence given a genuine opportunity to challenge that evidence?

5. Were political statements, advocacy and alleged criminal conduct clearly distinguished?

6. Were the rights protected by Articles 6 and 10 of the European Convention fully respected?

7. Did international cooperation influence the prosecution in a manner that could compromise judicial independence?

8. Can Finland demonstrate that the same legal standards would have been applied irrespective of the accused person’s political identity or the political pressure surrounding the Biafra question?

These are not questions of ethnicity. They are questions of law, evidence, due process and justice.

I reject the idea that the Igbo people should be collectively associated with FAKE terrorism of NIGERIA GOVERNMENT. (AG A MALAMI)

The political aspirations, grievances and historical questions surrounding Biafra must not be confused with criminal responsibility for particular acts.
