2. Diezani would be the defendant, not the plaintiff (or rather, not the prosecution, as it would be a criminal case)

While it is indeed a legal term, that's not how it is being used in this context. They meant that she is literally praying not to be investigated. Or, they don't know what a legal prayer is.
