As speaker he knows the rules! It is
within his rights to defect but he as
custodian of the law know the
consequences which is losing his seat as
legislator
So him adjourning the house for a lengthy
period just because he is changing paties
is irresponsible and Tambuwal/Janjweeds should
be ashamed of themselves
And what we are seeing quite frankly is how APC will govern if they are voted in. They will not respect the constitution and they will twist and bend it to suit their
personal interests!
At this point the behaviour of APC will
justify any extra-constitutional actions by
PDP just to remain in power.

Yes, in that respect, Tambuwal should/would not preside over such a session right? He can not be judge and jury over his own case.

If Tambuwal was an honest man, with integrity, he would have tabled his defection at the begin of discussing in the HOR, stepped aside to allow his deputy to head that session and let the house decide, but he was not honest, lacked integrity and was selfish, like all the politicians we have in Nigeria...

This is the result of his duplicity and PDP determination not to be used and dumped.
Obviously your reading and understanding faculty is nothing to be desired.


That section says and the poster explains that Tambuwal remains the Honourable Speaker of The House of Representatives of the Federal Republic of Nigeria whether the pdp constitution likes it or not.


Just as jonathan can not be a judge.
Go to the house and impeach Tambuwal and try and get another Speaker if you think you are popular.

The Constitution provides specifically that a member of the House of Reps loses his seat if he becomes a member of another political party. (Section 68(g) of the 1999 Constitution).This section is crystal clear. Stop calling Mimiko who is a governor. The section does not apply to governors!

There is a provision for switching parties that supercedes section 68(g).

What I know is that Lagos is in the SW part of Nigeria, Has no reasonable Resources apart from the fact that it was the formal capital and is the business/ commercial capital in Nigeria. Apart from it being the commercial hub in Nigeria what else?

Since folks have been too lazy to dig up stuff for themselves, here is the part of the Constitution of the FRN that pertains to the Tambuwal scenario

Chapter V
The Legislature
Part I

National Assembly


68. (1) A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -
(a) he becomes a member of another legislative house.

(b) any other circumstances arise that, if he were not a member of the Senate or the House of Representatives, would cause him to be disqualified for election as a member;

(c) he ceases to be a citizen of Nigeria;

(d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.

(e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.

(f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;

(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected;

Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or

(h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.

Now, the question is "Is PDP divided?" Remember that in the nPDP vs PDP scenario, a previous court ruling had ruled that PDP was not divided.

Tambuwal's best bet would been to allow the court explicitly state his case (even though its clear from above) AND not try to preside over the HOR. He pushed his luck too far...

ok thank God u know this the section says or factions by one of which he was previously sponsored and as at the time he decamped there was factions in the Pdp sokoto , so he is a smart guy besides a clever lawyer. So pdp and gej can ask the court to pronounce his seat vacant.

1. Court of law is different from HOA.
2. There was no member of the HOA that has raised that motion during any session in the House.
3. Even if 1 and 2 are TRUE, there is nowhere in the constitution that states the Speaker MUST step down for a discussion.

The position of governor is not the same as Speaker. The office of Speaker is naturally for the majority in the House, and in this case the PDP is the majority and not the other way round!
