The Osun State Election Petition Tribunal has fixed Friday, January 6 for the judgment of the petition filed by the Peoples Democratic Party (PDP) governorship candidate in the August 9, 2014 election, Iyiola Omisore. Omisore is challenging the victory of Governor Rauf Aregbesola of the All Progressives Congress (APC) at the governorship election. The PDP candidate is challenging the election before the Justice Elizabeth Ikpejime panel in some units and wards in 17 local government councils of the state. Omisore and his party, PDP, alleged that the August 9 governorship election was characterised by irregularities and manipulation in favour of APC and Aregbesola, thus asking the tribunal to cancel the election results in the affected local government councils. He is also praying the tribunal to declare him the winner of the election, saying he had the majority lawful votes, stressing that the votes cast for Aregbesola and APC are not lawful and, therefore, should be nullified. Secretary of the tribunal, Adamu Aliyu, confirmed the date of judgment to our correspondent. Counsels to all parties in the case had, two weeks ago, presented and adopted their written addresses before the tribunal. While presenting his written address, counsel to Omisore, Alex Izilyon, said the first respondent in the case, who is Rauf Aregbesola and his party (APC) have not proved their defence beyond reasonable doubt that the said election is not manipulated in favour of the APC. He said the petitioner’s evidences were weighty enough to declare Omisore the winner of the election. But Aregbesola urged the tribunal to dismiss the petition for lack of merit, being baseless and wasting of time. Represented by Akin Olujinmi and Rotimi Akeredolu, Charles Edohor, Aregebsola submitted that the specific allegations upon which the grounds of the petition were predicated are criminal in nature, adding that the petitioners have failed to prove the allegations beyond any reasonable doubt. They further submitted that the petitioners have failed to prove the liability of the first and second respondents in respect of the allegation beyond reasonable doubt as required by the law. http://dailyindependentnig.com/2015/02/osun-election-tribunal-delivers-judgment-friday/ |
