What type of job do you do for him?
Have there been issues of theft or sabotage in his company?
And, is your phone company or personal phone?

He has the right track his company issued phones if he suspects theft or sabotage.
He has duly informed you, so you cannot accuse him of surreptiously violating your privacy.

He caught our driver and one of my other colleague last week. This is affecting my movement and I've tried most of the mobile apps but I find it hard to see any app tracking a caller without his GPS being activated. True caller is not working either.

Try fake location or any other fake GPS apps... Fake location works for me...

If using an android phone try turning off the ''location'' indicator. Another way is put your SIM in a phone without GPS functionality. Yet, there's the surest way but it doesn't come cheap and criminals may use it, if I post it here. Don't ask me about it, please.

Listen all you need to do is to leave the Phone that he knows you with when you are leaving the office.... Meanwhile if you notice, though if you are a good observer....You notice that all the Police Vehicles you see stationed in all the Bus stop and majors junctions in Lagos has GPRS... when ever the Police want to leave their duty post with the vehicle to go and hustle on the street with the vehicle, a voice will call them from the control room not to leave their duty post. When they now noticed that the vehicles has GPRS, Police now device a means by leaving the said AMOURED PERSONEL CARRIER OR Hilux truck at the said junction and use Lagos Yellow bus to go and hustle for defaulters. hahahahahahahah.

Threaten him with a lawsuit. He has not right to track you as a worker, provided, the agreement you signed didn't state anything relating to that or subject you to being tracked. It is partially torture and if he sacks you because you had to take care of personal stuffs and you didn't violate the bye-laws of the company, he has no right to track you. If you want to justify my opinion, it's in accordance with the provision of the 1999 constitution of Nigeria.

See section 35 subsection 1
which states that Every person shall be entitle to his personal liberty and no person shall be deprived of such liberty save in the following cases and in accordance with procedure permitted by law.

Also see Section 36 subsection 12

Subject as otherwise provided by this Constitution, a person shall not be convicted of a criminal offense unless that offense is defined and the penalty therefor is prescribed in a written law, and in this subsection, a written law refers to an Act of the National Assembly or a Law of a State, any subsidiary legislation or instrument under the provisions of a law.

Also See Section 37.

37: The privacy of citizens, their homes, correspondence, telephone conversations and telegraphic communications is hereby guaranteed and protected.


But if you feel the need to keep accepting that kind of treatment, You can ideally stay in one place during work hours sha..But if you want to proceed with a lawsuit, I can guarantee you can make a lot of money from the case. Just find a lawyer and tell him/her your situation. I'm sure they can represent you Pro bono.

His boss has no right to track to the person in question's movement. No matter what the bye-laws of the company says, the constitution supersedes any other law if it's inconsistent with it's provision. And as long as the person in question is not convicted as a criminal he has a right to privacy.

It is justifiable to accuse his boss of violating his privacy, and even if his boss has duly informed the person in question earlier and it has not being more than 3years. If the knowledge of is more than 3years it could be considered "acquiescence" But on rare occasion can his boss attitude be justifiable.

Well, in this case, the person in question didn't state whether it's a company phone. He quoted, "My boss is Tracking my phone" It's is to some extent justifiable if it's a company phone, but if it isn't the boss is overstepping his boundaries.

If he wants to monitor you in real time then he would use GPS. If he wants a log of where you you have been, he doesn't need GPS. it's easy to do, especially if you use a smart phone that it is rooted or jailbroken. can't tell you how though.
also, switching sim to another phone wouldn't help. If he's really smart, he will catch you

depends on the company he's working for, if the term was stated in the appointment letter and if the boss has easy assess to the phone.it's quite easy to do. some guys use it to trace their girlfriends when they have trust issues

actually sir he isn't tracking ur phone per say. he is tracking the vehicle. I think he is doing this mtn vehicle track or so. that's y he was so confident to boast to u guys regardless of whether u guys could off ur phone. somewhere in the vehicles are mtn tracking device (just saying. .Dont go scattering the car looking for the mole). so except u have a sinister plan.....calm down. oluwa is involved.

@OP: If u n ur boss use Viber app, it makes the job easier 4 ur boss. The app shows ur exact location n d street u currently are. My woman is using dat to track me all d way frm Canada. Lol.. Except I switch off my mobile app data whc I can't do!!
